Pursuant to the New Mexico Inspection of Public Records Act, I hereby request the following records:

Any and all directives, orders, plans, and communications issued to officials and managerial staff within facilities under the jurisdiction of this agency, as well as those provided to individuals under the supervision of this agency, regarding preparatory or responsive measures and requirements related to COVID-19, also known as coronavirus.

Please include as responsive any relevant plans and directives issued regarding inmate health, behavior, and participation in preparatory and defensive activities, including those conducted by the correctional industry program.

If you have any questions about this request, please call 617-299-1832.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 15 business days, as the statute requires.

I am in receipt of your public records request dated 3-9-20. Pursuant to 14-2-8(D) of the IPRA, you will be provided with this agency's response, including whether the Department has any objections (based on exemptions provided in the IPRA), within 15 days of receipt of your request, on or before 3-24-20.

However, pursuant to 14-2-10 of the IPRA if the Department determines that your request is excessively burdensome or broad, you will be notified within the timeframe noted above and provide you with an estimate of how much additional time will be needed to comply with your request.

Please be advised that any attorney client or confidential information otherwise protected by law will not be subject to inspection.
Should you request copies of records, you will be required to pay the fees imposed by the New Mexico Department of Corrections, pursuant to provisions of the Inspection of Public Records Act Section 14-2-1 through 14-2-16, NMSA 1978, of $.25 per page for 11 x 17 inches or smaller.

Due to the statewide shelter in place, your IPRA response will be completed on or before 4/10/20. Pursuant to public health guidelines during the state of emergency, all in-person in inspection of public records during the pendency of the state of emergency is suspended. We will make every effort to comply with the mandates of IPRA by producing records electronically. If circumstances arise where records are not available electronically and cannot be produced in the timeframes mandated by IPRA, an agency may designate a request as excessively burdensome due to the state of emergency, and communicate to the requestor that the request will be fulfilled as required by IPRA when the state of emergency is lifted.

We will notify you at that time, if any additional time is needed.
