Hello Joseph,

I wanted to reach out to you about the fees associated with this request. Going by the attachment that you sent me, it is unclear why this office is charging me $328 for this request. I would like to add that as of today (April 24th), 17 states have been able to fulfill this exact same request for free. Can you please elaborate on the $328 fee?

Thanks,
Mackenzie Farkus

As stated in the response:

N.J.S.A. 47:1A-5(d) provides:

If a request is for a record: (1)in a medium not

routinely used by the agency; (2)not routinely

developed or maintained by an agency; or (3)

requiring a substantial amount of manipulation or

programming of information technology, the agency

may charge, in addition to the actual cost of

duplication, a special charge that shall be

reasonable and shall be based on the cost for

any extensive use of information technology,

or for the labor cost of the personnel providing

the service, that is actually incurred by the

agency or attributable to the agency for the

programming, clerical, and supervisory assistance

required, or both.

A program to cull the information you seek must first be written. It is tested then tested before the actual program is run. This is necessary to cull the data from the MVC's thirty four year old database. Your request seeks information dating back to 1997. Please be advised that it is extremely unlikely that Information prior to 2005 will be available. The MVC did not begin "data warehousing" until 2005.
