Pursuant to Open Public Records Act ("OPRA"), I hereby request the following records:

I request all relevant documents including but not limited to: license histories and certifications of all registered Bail Enforcement Agents (also known as BEA's, Bounty Hunters, bail agents, recovery agents, bail recovery agents, skip tracers, or fugitive recovery agents). I also ask for a syllabus or other form of documentation outlining the information covered in the "Bounty Hunting Training Course" offered by New Jersey State Police, Private Detective Unit in accordance with the Bounty Hunter Licensing Act

If possible, I also request a complete list of all revoked, terminated, expired, or out-of-date bail enforcement licenses.

Given that this FOIA is submitted in my capacity as a journalist, I request that I be categorized as a media requester for the purpose of fees.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 7 business days, as the statute requires.

Dear Ms. Sitrin:

I just received the e-mail that you sent via MuckRock.

First and most important, in accordance with regulation, N.J.A.C. 13:1E-2.4, submission of OPRA requests to any of the divisions or agencies of the Department of Law and Public Safety (L&PS) by fax or e-mail is not permitted. Therefore, I cannot accept your e-mail as an OPRA request.

There are a number of practical reason for this. For instance, part of your e-mail was stripped by an anti-virus program. You can file such an OPRA request over the Internet by using the electronic State request form which can be found at the L&PS OPRA web page, www.state.nj.us/lps/opra<http://www.state.nj.us/lps/opra>.

The records that you seek are not in the possession of Office of the Attorney General, but may be in the possession of a different division of L&PS, the Division of State Police. You may wish to file an OPRA request directly with the Division of State Police.

After I responded to your e-mail, I discovered that you did indeed file an OPRA request online with OAG. I will be out of the office on Wednesday, but I will respond to your OPRA request later this week. It is unlikely that the records you seek are in the possession of OAG, but they may be in the possession of other L&PS divisions, the Division of State Police or the Division of Criminal Justice. You may want to file OPRA requests online directly with the Division of State Police and/or the Division of Criminal Justice.
