Pursuant to the New Jersey Open Public Records Act, I hereby request the following records:

I, Cindy Franco, am requesting a copy of my unemployment application from 9/15/2019. Along with a transcript or audio copy of the appeal hearing that was held on 11/8/2019.

I intend to file another appeal and require these documents to present to an attorney.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 7 business days, as the statute requires.

Ms. Franco - Under the New Jersey Unemployment Compensation Law (UCL); specifically, N.J.S.A. 43:21-11(g), the unemployment compensation (UC) records you seek are confidential and shall not be published or open to public inspection other than to public employees in the performance of their duties, or to a claimant at a hearing before an appeal tribunal, the Division of Unemployment Insurance, or the board of review, to the extent necessary for that claimant to properly present her claim. Since you indicate that you require the records in order to pursue an administrative appeal before the Department, you would be entitled to the UC records you seek. However, your request is being made not by you directly, but rather, through MuckRock News, which indicates in its email that it is making the request "in order to better track, share and manage public records requests" (emphasis added). I am sure you can appreciate why the Department cannot provide your confidential UC claim records to a news organization that has expressly indicated its intent to "share" those records.

If you wish to have your confidential UC claim records sent to you directly, then please provide a verifiable home address (verified by checking against the address you provided on your UC claim), and the Department will send the requested records to you at that address.

Immediately upon receipt of the earlier request (and after responding in writing to the request), I forwarded it for disposition to the Division of Unemployment's government records custodian. Attached is the letter sent to Ms. Franco by the DUI custodian in mid-July.
