To Whom It May Concern:

Pursuant to the New Jersey Open Public Records Act, I hereby request the following records:

I'm interested in documents including emails, vendor solicitations, requests for proposals, and project proposals related to Apple Wallet ID card program, which is referenced publicly on their website here: https://www.apple.com/ios/ios-15-preview/ While the program is publicly announced, they have not shared participating states and I'm interested in any responsive documents whether or not the state has decided to participate in the program.

If you have any suggestions on how to better tailor my request to provide useful results while minimizing the burden on the agency to complete it, please let me know.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 7 business days, as the statute requires.

Sincerely,

Matt Zagaja

Dear Mr. Bruno,

Thank you for taking the time to respond. Responses from other states have indicated there are also non-RFP related conversations on this topic, and I was wondering if there might be any emails or communications with Apple on this topic. Specifically using the keywords:

Anything that has in the from/to fields: "*@apple.com"

Anything in the email subject or body: "Apple Wallet", "Digital Identity", "Travis Feuerbacher", "Gail Hodges", "Mark Lennon", "Irene Graff"

Could you let me know if there are any responsive communications based on those keywords?

Thanks again,

Matt

Mr. Zagaja:

The MVC's IT unit has informed me that it would take approximately 5 hours of programming to accommodate your request.

N.J.S.A. 47:1A-5(d) provides:

If a request is for a record: (1)in a medium not
routinely used by the agency; (2)not routinely
developed or maintained by an agency; or (3)
requiring a substantial amount of manipulation or
programming of information technology, the agency
may charge, in addition to the actual cost of
duplication, a special charge that shall be
reasonable and shall be based on the cost for
any extensive use of information technology,
or for the labor cost of the personnel providing
the service, that is actually incurred by the
agency or attributable to the agency for the
programming, clerical, and supervisory assistance
required, or both.

Therefore, the estimated fee for the information identified in your request is $410.00.

5 hours of MVC programming at $82.00/hour.
