Re: Open Public Records - Prostitution, etc.

Dear M. Dante,

The New Hampshire Department of Corrections is in receipt of your faxed Open Records request for "2012-2017 Incarcerations for prostitution, pimping, forced slavery, sex trafficking, and human trafficking." We are able to respond to your request but only in limited form.

The New Hampshire Department of Corrections maintains a monthly tracking document of sentences being served in state-run facilities by Revised Statute Annotated (RSA). We do not specifically track this information as a stand-alone document.

Instead, we have provided you with documents that show all of the sentences being served by RSA for the time frame of January 2016 to May 2018. We do not keep these documents historically back to 2012. RSA 91-A:4,VII states "Nothing in this chapter shall be construed to require a public body or agency to compile, cross-reference, or assemble information into a form in which it is not already kept or reported by that body or agency."

You can look at the State of New Hampshire's official website to ascertain which RSA's in these documents apply to your specific requests. I can tell you that Human Trafficking is covered by RSA 633:7 and Prostitution and Related Offenses are covered by RSA 645:2. If you look at the attached documents you will be able to see how many persons are serving sentences for those RSA's.

These documents should complete our obligation under RSA 91-A.
