Pursuant to the New Hampshire Right to Know Law, I hereby request the following records:

• All policies related to the employment and payment of incarcerated persons under the jurisdiction of this agency.

• The most recent report regarding currently-employed incarcerated persons under the jurisdiction of this agency. Please include all available segregable information, including the type of employment, the wage at which the employment occurs, and any other applicable information. Please do not include any personally identifying information.

• All reports regarding post-incarceration employment for individuals formally under the jurisdiction of this agency.

If no such reports exist and if reports with equivalent information also do not exist, confirmation of the fact that no data at all exists on this subject will suffice.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

Dear Beryl Lipton,

The New Hampshire Department of Corrections is in receipt of your request for documents under the right to know law. We have attached documents that are responsive to your request.

You asked for all policies related to the employment and payment of those in our jurisdiction. We have enclosed copies of the following policies.

3.01 - Offender/RTU/SPU Resident Pay System
3.06 - Resident Accounts at Transitional Housing Units
3.09 - Management and Control of Personal Funds of Residents
7.47 - Phases and Programming at Transitional Housing Units
7.64 - Registered Apprenticeship Program

To the extent of your second request for the most recent report regarding currently-employed incarcerated persons under the jurisdiction of this agency. This data is tracked in a broad format but includes some skill levels and facility in which the individuals are housed.

You also asked for all reports regarding post-incarceration employment for individuals formally under the jurisdiction of this agency. No such document exists. RSA 91-A:4, VII states, “Nothing in this chapter shall be construed to require a public body or agency to compile, cross-reference, or assemble information into a form in which it is not already kept or reported by that body or agency.”

To the extent that these represent all available documents that are responsive to your request, we will continue to review our records and if further documents are found that are responsive to your request those will be provided.
