From: Office of the Governor - New Hampshire

Good morning,

I apologize for the delayed response to this request. Please be advised that it is the long standing position of the New Hampshire Department of Justice that RSA 91-A does not apply to the Governor’s office. We respond to these types of inquiries under Part 1, Article 8 of the New Hampshire Constitution, and therefore are not subject to the 5 business day time limit. Nevertheless, we endeavor to respond to these inquiries as quickly as possible.

Upon review of all records in the custody or control of this Office that are potentially responsive, I have concluded that all of these records constitute drafts, notes, and/or strategic and deliberative processes under the Executive Privilege, and are therefore exempt from disclosure.

Please do not hesitate to contact me if you have further questions.
Thanks,

John
