Pursuant to the New Hampshire "Access to Government Records and Meetings" Statute (RSA Ch. 91-A), I hereby request the following records:

Records relating to bail enforcement Agents also known as BEA's, Bounty Hunters, bail agents, bail recovery agents, bail recovery agents, skip tracers, or fugitive recovery agents. An itemized list of the records I am requesting about BEA's follows:

-Any training material including syllabi, power point presentations, or any distributed reading material. Please conduct this portion of the search from 1/1/05 to the date this request was processed on.

-Any regulations, policies, guidelines, or any other rules made to limit or manage what a BEA can and cannot do.

-Use of force policies for BEA's.

-All complaints against any BEA licensed or permitted by this agency with the following date range: 1/1/05 to the date this request is processed on.

-Financial documentation concerning the gross income of the Bail Enforcement industry in the state. In addition or in the event the agency does not keep documentation about the overall finances going to Bail Enforcement, any documentation about billing, salary/payment range, or potential benefits are also requested.

-Number of injuries and fatalities reported per year from the Bail Enforcement industry from 1/1/05 to the date this request was processed.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

The N.H. Department of State, Bureau of Securities ("the Bureau") has been asked to respond to your RSA 91-A request for records pertaining to Bail Enforcement Agents.

This Bureau had regulatory oversight of Bail Recovery Agents as set forth in N.H. RSA 597-A from the early 1990's until December 31, 2016. Effective January 1, 2017, regulatory oversight was transferred to the N.H. Department of Safety, State Police, Permits & Licenses Unit located at 23 Hazen Drive, Concord, N.H. The current governing statute for bail recovery agents is N.H. RSA 106-F.

This office is able to respond to your inquiry as it pertains to documents and/or information in the Bureau's possession for the period ending December 31, 2016.

-Any training material including syllabi, power point presentations, or any distributed reading material. Please conduct this portion of the search from 1/1/05 to the date this request was processed on.
Response: The Bureau does not have any such training material on file. Prior to January 1, 2017, any applicant for bail recovery agent registration was required to show proof of having received training in bail recovery activities through a course approved by the Professional Bail Agents of the United States. I am aware that such courses of study were made available at different times by a Mr. Lance Wilkinson of Goffstown, N.H. , and later by a Mr. Frank Abramovich of Manchester, N.H. However, both are now deceased.

-Any regulations, policies, guidelines, or any other rules made to limit or manage what a BEA can and cannot do.
Response: See N.H. RSA 106-F.

-Use of force policies for BEA's.
The Bureau did not have any such policies in place. You may want to confer with the N.H. State Police licensing unit regarding any such policies that may be currently in place. .

-All complaints against any BEA licensed or permitted by this agency with the following date range: 1/1/05 to the date this request is processed on.
Response: No complaints on file. You may want to confer with the N.H. State Police licensing unit for any complaints that may have been filed since January 1, 2017.

-Financial documentation concerning the gross income of the Bail Enforcement industry in the state. In addition or in the event the agency does not keep documentation about the overall finances going to Bail Enforcement, any documentation about billing, salary/payment range, or potential benefits are also requested.
Response: No such records were ever required nor maintained by the Bureau.

-Number of injuries and fatalities reported per year from the Bail Enforcement industry from 1/1/05 to the date this request was processed.
Response: No such information on file.
