Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, ยง10, I hereby request the following records:

Purchase orders, contract and invoices from vendors for FY 2012 from Guido's Plate Glass Service and Stan and Paul's Inc

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This is in response to your request for information pursuant to the provisions of M.G.L. c. 66, section 10 (the "Public Records Law") addressed to the New Bedford City Clerk. We have compiled the documents that answer your request.

As you are aware, the City is entitled to payment for the costs of researching, segregating and copying. Kindly forward a check made payable to the City of New Bedford to my attention in the amount of $57.44 for the researching, segregating and copying charges. The breakdown is as follows:

23 pages x .20 per page = $ 4.60

4 hours for least paid person
capable of performing duties
at $13.21/hr. = $52.84

TOTAL COST $57.44

Upon receipt of the check I will have the documents sent to you within two business days.

I am trying to understand how it could take someone 4 hours to retrieve and copy the requested information. How is the information organized and stored? "A records custodian may not recover fees associated with record organization."

Mr. Grogan:

I apologize...but for some reason I did not receive your May 20, 2014 email below. The records you requested are in storage in our attic. A clerk had to actually find the warrant and copy the documents that were responsive to your request. The FY 12 records are not maintained electronically. In accordance with A Guide to the Massachusetts Public Records Law published by the Secretary of State, "A records custodian may charge and recover a fee for the time he or she spends searching, redacting, photocopying and refilling a record." We are aware that we cannot charge for record organization.
