Pursuant to the Nevada Public Records Act, I hereby request the following records:

Any and all policies and procedures regarding the recount of federal, state, or local ballot initiatives, including all materials regarding the following specific points:

• All policies and procedures regarding the initiation of a request to recount votes regarding a particular candidate position or ballot initiative
• All policies and procedures regarding the technical, practical measures for execution of a recount
• All policies, procedures, and considerations regarding the cost and budget of an execution of a recount
• All policies and procedures regarding the tallying and reporting of a vote recount

Please provide relevant procedures for jurisdictions under this agency.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Please contact the Nevada Secretary of State’s Office, nvsos.gov. You may also want to consider contacting the registrar of voters for any Nevada county in which you are interested. Ms. Lipton: Recount procedures are set forth in Nevada law in Nevada Revised Statutes (NRS) 293.400 through NRS 293.405 at http://www.leg.state.nv.us/NRS/NRS-293.html#NRS293Sec400 and Nevada Administrative Code (NAC) 293.361 through 293.375 at http://www.leg.state.nv.us/NAC/NAC-293.html#NAC293Sec361 .

We do not have any written policies and procedures related to recounts other than what is in statute and regulations. The Secretary of State publishes an informational guide, Recount and Contest Guide, which is available on our website at http://nvsos.gov/sos/home/showdocument?id=3841 The stated purpose of the guide is to provide a general understanding of the procedures and requirements necessary for demanding and receiving a recount or contesting an election. The guide is for general information only and does not have the force and effect of Nevada law, regulation or rule.
