Pursuant to the Nebraska Public Records Statutes, I hereby request the following records:

A log of public records requests submitted to the Department of Health and Human Services that lists the date of request, the requester's name, the requester's organizational affiliation, a description of the request and the date the request was filled. Ideally I would like this information for the period from 2004 to the present.

The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, and is made in the process of academic research and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you for your response.

Since it would require extensive effort to compile the requests in your office, would it be possible for you to send me copies of the all the requests the office has received instead? I could then compile the information on my own time. This approach has worked for departments in several other states that did not maintain a log and expressed similar concerns about the time it would take to compile one.

Dear Mr. Peterson:

The earliest practicable date for fulfilling the attached public records request is: Friday June, 5, 2015.

It is our understanding that you are requesting only a copy of the public records requests that were received by DHHS, and that you are no longer requesting the date the request was filled.

The estimated cost of fulfilling your request is: $288.20

The estimated cost was calculated as follows:

DHHS estimates that it would take a Program Specialist 14.10 hours to gather copies the public records requests. The first 4 hours of Program Specialist time gathering public records requests are free. The Program Specialist rate of pay is $28.37 per hour. 10.10 hours multiplied by $28.37 equals $286.53. The information would be provide on a compact disk. The cost of the disk is $1.67.

You have ten business days to:

· Forward a check in the above amount, payable to DHHS, to the address below. The records will be provided to you after payment is received.

· Negotiate with DHHS to narrow or simplify your request; or

· Withdraw your request.

You have a right to administrative or judicial review of this decision pursuant to Neb. Rev. Stat. §84-712.03.
