Pursuant to the Nebraska Public Records Statutes (Neb. Rev. Stat. ยง 84-712), I hereby request the following records:

Documents pertaining to the deployment of personnel in regards to the North Dakota Governor Jack Dalrymple issuing a state of emergency in response to protests at Standing Rock over the construction of the Dakota Access Pipeline. Documents sought are as follows:
-memos or requests received from the North Dakota Governor's Office, Morton County Sheriff's Department, North Dakota Emergency Management Agency, or North Dakota Highway Patrol for help under the Emergency Management Assistance Compact.
-emails with the aforementioned North Dakota agencies regarding the Standing Rock protests and/or personnel sent there to help with emergency management
-memos, emails, and requests sent internally with regards to the decision to deploy officers to North Dakota to help with controlling the protest
-Requests from the aforementioned North Dakota agencies for specific equipment to be brought to the Standing Rock protest area for their use in controlling the protest. This equipment may include but is not limited to surveillance devices including cell site simulators or social media surveillance software, or crowd control methods such as long range acoustic devices, water cannons, rubber bullets, tear gas, pepper spray or tasers.
-any bills, contracts, agreements, invoices, or other financial documentation for services rendered in helping to control the Standing Rock NoDAPL protests. These documents would likely be sent to the 4 aforementioned North Dakota agencies.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Mr. Waltman:

The Nebraska State Patrol is in receipt of your public records request.

Your request for documents relating to the EMAC to North Dakota will result in a tremendous amount of documents, into the thousands. While we will not charge you for a search for the records, the cost of copying them must be recovered for the sake of the Nebraska taxpayer. At this point, in order to provide every document from every member of the agency, it is estimated that it would take ninety days. Sixty days would be for officers in the Troop areas to complete the searches around their days off, vacation schedules, and other duties. Thirty days would be for the review of the documents and processing by this office.

As it is anticipated that the number of documents will exceed 8000 pages, to provide all of the documents would require a deposit of $1000.00. If you wish to reduce the size and scope of your request, I would recommend that you consider only requesting to documents of those particular persons who work for the agency who you believe would have documents that interest you the most. I have enclosed a break down and estimated numbers of records for persons in the agency by their rank or position.

Colonel-Estimated 300 pages at a cost of $75.00
Lt. Colonel-Estimated 500 pages at a cost of $125.00
Field Services Major-Estimated 1000 pages at a cost of $250.00
Investigative Services Major-Estimated 250 pages at a cost of $62.50
Administrative Service Major-Estimated 250 pages at a cost of $62.50
Captains- There are 14 Captains with an estimated 100 pages each at a cost of $350.00
Lieutenants-There are 30 Lieutenants with an estimated 50 pages each at a cost of $375.00
Officers not part of the management team-404 with an estimated 5 pages each at a cost of $505.00

**Financial records are not yet completed and your request for those records will have to be resubmitted at a later time when they are in fact completed, most likely after the 1st of the year.**

Let us know if you wish to break this request down by title and rank to reduce costs and send the deposit for that rank and we can begin processing your request.

The deposit would need to be in a check format and made payable to the State of Nebraska and reference PRR016-181 in the memo. The deposit should be mailed to:
