Pursuant to the California Public Records Act, I hereby request the following records:

Contracts and invoices related to the use of communication services at any and all county correctional or detention facility locations under the jurisdiction of this agency. This may encompass telecommunication, kiosk, and mobile tablet services.

Please provide the following relevant materials.

• Any and all open or active Requests for Proposal or similar solicitations regarding the provision, installation, maintenance, or use of communication services. If available or applicable, please also provide equivalent materials for video conferencing equipment and other electronic communication and telecommunication services.

• Any and all active contracts regarding the provision, installation, maintenance, financial requirements, associated commissions, or use of communication services. Please include all associated supplemental materials, including any and all attachments, amendments, and exhibits. Please provide any other materials regarding the terms of service, including the term and expiration date of the current contract, as well as any optional contract extensions. Please include the name of the current telecommunication provider, as well as the services currently being provided pursuant to the agreement. Relevant companies include, but are not limited to, CenturyLink, City Tele Coin, ICSolutions, JPay, and Securus Technologies.

• Any and all financial reports, commission reports, revenue reports, and invoices related to the provision, installation, maintenance, or use of communication services. Please include all usage and fee reports, providing as much segregable data as possible, including, but not limited to, the rate at which the funds were generated, the revenue generated for each service, the timeframe during which the funds were generated, the nature of the communication's payment (collect, prepaid, inmate account), etc. If available, please also provide equivalent materials for video conferencing equipment and other electronic communication and telecommunication services.

Please provide all current contract materials and invoices for the period January 1, 2015 through the date this request is processed.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

We have received your request, however we do not have a contract at the Napa County Sheriff’s Office for communications services. The Napa Sheriff’s Office does not have a Jail under its direction. For this reason we do not have a need for a communications services contract.

Dear Ms. Lipton,

Napa County received your Public Records Act request seeking records relating to video and communications contracts utilized by the Napa County Department of Corrections.
California Government Code section 6253(c) provides in part as follows: “Each agency, upon a request for a copy of records, shall, within 10 days from receipt of the request, determine whether the request, in whole or in part, seeks copies of disclosable public records in the possession of the agency and shall promptly notify the person making the request of the determination and the reasons therefore. In unusual circumstances, the time limit prescribed in this section may be extended by written notice … to the person making the request, setting forth the reasons for the extension and the date on which a determination is expected to be dispatched. No notice shall specify a date that would result in an extension for more than 14 days.”
This response therefore serves as written notice of the need for an extension of time for your request. The reasons for the extension include:

· The need to search for, collect, and appropriately examine a voluminous amount of separate and distinct records that are demanded in a single request. (Govt. Code section 6253(c)(2).)

· The need for consultation, which shall be conducted with all practicable speed, with another agency having substantial interest in the determination of the request or among two or more components of the agency having substantial subject matter interest therein. (Govt. Code section 6253(c)(3).)

· The need to compile data, to write programming language or a computer program, or to construct a computer report to extract data. (Govt. Code section 6253(c)(4).)
We have initiated the processing of your request to identify records and determine if any records are exempt from disclosure pursuant to Government Code section 6254. We aim to have a determination dispatched no later than June 18, 2018, which will inform you of the anticipated date when any disclosable records will be made available for your review or copying, the copying charges if known, and the explanation for not disclosing any exempt records.

Request #3 – Financial reports, invoices, etc. relating to communications services

Should you wish to receive physical copies of the uploaded documents, the County can provide them upon payment of the applicable photocopy rates. The County’s adopted photocopy rates for black and white standard size documents (8-1/2 by 11 and 8-1/2 by 14), which are based on its actual copying costs (machine lease, materials, time of clerk to assemble and disassemble documents and feed the machine), are $3.00 for up to 5 pages of each individual document and $0.10 per page for each additional page of that same document. The cost for photocopying the documents you have requested, if you would like physical copies, is $83.70. Copy fees must be paid in advance, along with the cost of mailing if mailing is desired.
