Pursuant to the California Public Records Act, I hereby request the following records regarding this agency’s procedures for handling alleged and actual acts of domestic violence by its employees:

POLICIES and PROCEDURES
• The current or most recent applicable policy and guidance regarding this agency's response to complaints and allegations of domestic violence made against its employees
• All policies and guidance related to reporting by this agency (to the state government, federal government, private researchers, and any other party) of domestic violence committed by or alleged against employees of this agency
• A blank copy of all forms and logs used in the process of recording and addressing domestic violence allegations against and investigations of employees of this agency

COMPLAINTS and INVESTIGATIONS
• All materials (including but not limited to all complaints, reports, investigatory materials, internal affairs reports, and any other records) related to all allegations of domestic violence made against employees of this agency for the period from January 1, 2010 through July 31, 2020.
• All aggregate data related to allegations and investigations of domestic violence committed by this agency's employees for the period from January 1, 2010 through July 31, 2020.
• All reports, data, and other reporting materials provided by this agency to any other entity (including but not limited to the state government, the federal government, private researchers, and any other party) on domestic violence committed by or alleged against employees of this agency

This request is being made by a reporter as part of a journalistic investigation. It is being submitted to your agency at the suggestion of a MuckRock reader from your community, part of a project to better understand uses of police force nationwide. This has been of public interest for many years and is of particular interest to the public following the widely-seen death of George Floyd and subsequent First Amendment-protected demonstrations and public discussion. There is no commercial interest in making this request or in receiving responsive records.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Good Afternoon Beryl,

The City of Napa is in receipt of your August 6, 2020 Public Records Act request. This request will require the City to search for a voluminous amount of records from multiple departments and from locations separate from the City Clerk’s Office. For these reasons, the City is invoking the extension of time provided by California Government Code Section 6253(c).  Accordingly, I anticipate that we will be able to formally respond to your request no later than August 31, 2020, if not sooner.

In regard to the portions of your request for “policies”, the City is providing you readily available records including a copy of the Napa Police Department Policy Manual. The City of Napa is in receipt of your August 6, 2020 Public Records Act request. As stated in the City’s response dated August 17, 2020, a fourteen-day (14) extension was necessary to respond to your request due to the need to search for a voluminous amount of records from multiple departments and from locations separate from the City Clerk’s Office. Your request is outlined below for reference along with the City’s response.

POLICIES and PROCEDURES

* The current or most recent applicable policy and guidance regarding this agency's response to complaints and allegations of domestic violence made against its employees

* All policies and guidance related to reporting by this agency (to the state government, federal government, private researchers, and any other party) of domestic violence committed by or alleged against employees of this agency

* A blank copy of all forms and logs used in the process of recording and addressing domestic violence allegations against and investigations of employees of this agency

The City responded to this portion of your request on August 17, 2020 by providing a link to Napa Police Department’s Policy Manual located on the City’s website: https://www.cityofnapa.org/889/Napa-Police-Department-Policies-and-Trai Please refer to NPD Policy 1012 – Personnel Complaints on Page 691.

In addition to providing a website link to the Napa Police Department’s Policy Manual, the City is also providing copies of our administrative regulations for employees related to conduct and discipline. You may view these responsive records by clicking on the link below.

Please note that the Napa Police Department does not possess any responsive records related to specific/separate form or logs used to record domestic violence involving police officers. Any reports of alleged offenses would be made in the same manner as any crime report.

The City is providing a copy of a blank form for the Napa Police Department’s Citizen Complaint Procedures. Please note that this is a general form used for any complaints made against our officers and this form is not required in the process of recording and addressing domestic violence allegations against and investigations of employees of this agency.

COMPLAINTS and INVESTIGATIONS

* All materials (including but not limited to all complaints, reports, investigatory materials, internal affairs reports, and any other records) related to all allegations of domestic violence made against employees of this agency for the period from January 1, 2010 through July 31, 2020.

* All aggregate data related to allegations and investigations of domestic violence committed by this agency's employees for the period from January 1, 2010 through July 31, 2020.

* All reports, data, and other reporting materials provided by this agency to any other entity (including but not limited to the state government, the federal government, private researchers, and any other party) on domestic violence committed by or alleged against employees of this agency

City staff from Napa Police Department conducted a search for records for under the date range of January 1, 2013 through July 31, 2020 and there were no materials related to allegations of domestic violence made against employees of this agency. Please note the records related to internal affairs investigations prior to 2013 have been destroyed per our City’s retention schedule.

The City does not possess any responsive records to this portion of your request under Complaints and Investigations. Therefore, there are no aggregate data to report, and no reports, data, or other reporting materials provided by this agency to any other entity on domestic violence committed by or alleged against employees of this agency.

The decisions expressed in this letter have been made by me in consultation with Police Lt. Gary Pitkin. We trust this satisfies your request, and we will consider the request closed.
