Pursuant to the Texas Public Information Act, I hereby request the following records:

All database reports regarding reports of custodial deaths. Please include all available segregable data, including, but not limited to, the individual, the facility in which he or she was being held at the time death, the facility at which the death occurred, the cause of death, the manner of death, the offense for which the individual was being held, etc.[For reference: https://muckrock.s3.amazonaws.com/foia_files/DOC_2.pdf ; https://www.texasattorneygeneral.gov/criminal/custodial/report_deaths.php]

This request is being made as part of a journalistic investigation. The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Dear Mr. Lipton:

Please be advised that the Office of the Attorney General (“OAG”) does not maintain custodial death reports (“CDRs”) electronically prior to 2005. Accordingly, we cannot provide the requested information prior to 2005. Of course, we maintain the actual CDRs for this period. If you would like the CDRs from this period, we will be happy to provide you with a formal cost estimate. As for your modification, the OAG does not request entities to inform us whether the inmate was in segregation at the time of death. We can only provide that information if the entity included that fact in its report. Thank you.
