Pursuant to the Washington Public Records Act [RCW 42.56] I hereby request the following records:

I request a complete electronic copy of all Public Records Requests received by Spokane Public Schools District and a complete electronic copy of the District's Responses to these Public Records Requests for the time period January 1, 2010 through November 4, 2021.

In the event the District chooses to provide these records in installments over time I request the records to be produced in reverse chronological order - from the most recent records to the earliest.

If this request is denied in whole or part, I ask that you justify all deletions by reference to specific exemptions of the PRA. I also request a detailed contemporaneous log to be provided for any document withheld or redacted.

For each responsive record the District contends is exempt from public disclosure, in whole or in part, please specifically identify the record by subject, title, author, custodian and date, and state how a specific statutory exemption applies to each record as required by RCW 42.56.210(3) and Rental Housing Ass'n v. Des Moines, 165 Wn.2d 525, 199 P.3d 393 (2009).

I request electronic production of all electronic records in the original NATIVE electronic format for each record.

I request for these public records to be produced by public (no password) e-mail attachment or link. If electronic attachment or link is not possible, an alternative would be to produce responsive records via USB DRIVE or DATA CD-ROM.

In order to process your request, we find clarification is necessary. Please clarify if you are seeking records released in response to these requests, or just the communication responding to the request, without the records that were provided in response to the request.

This clarification is necessary because, as a school district, many of our requests are made by parents or legal representatives of students requesting email records that discuss students and students’ education. Student records are protected under RCW 42.56.230 and the Federal Education Rights and Privacy Act (FERPA). Redacting these records in order to release them to you will take a considerable amount of time.

The same holds true for public record requests made by staff members for records, which would be released largely unredacted to the staff member but would require considerable redactions prior to releasing them to anyone else. Our Collective Bargaining Agreements also require notification require prior to releasing records that discuss staff, even in a redacted state. We would like to provide the records you are seeking as quickly and efficiently as possible but would like to avoid additional time-intensive work if you are not seeking those records.

As our office follows the record retention schedules established by the Washington Secretary of State, we will not be able to provide records dating back to 2010. We will work with our technology staff to retrieve electronic records dating back to June 30, 2017.

The Washington State Public Records Act, chapter 42.56 RCW, and more specifically RCW 42.56.520 recognizes that additional time to respond to a request is allowed when needed to clarify the intent of the request, to determine if any of the information requested is exempt, to notify third parties affected by the request, or to locate and assemble the information requested. Given the nature of the request, that is the case here. The District anticipates being able to release records on or before January 4, 2022. The sooner you respond to our request for clarification, the sooner we will be able to begin work on your request. Please let us know if you are no longer seeking records to this request.

After some investigation, it has come to our attention today that you updated your mailing address and informed us of your new address via U.S. Mail instead of responding to my email. In preparation for your upcoming installment, the District has continued to review and redact records that it believes may be responsive to your request. In doing so, it has encountered a set of records for which we do not necessarily believe additional clarification is required. However, in an abundance of caution, the District does want to reach out and touch base with you in order to ensure that its understanding of your clarification to our previous correspondence continues to remain accurate, and that the District is thus continuing to fulfill its obligations and duties in ensuring that you are provided with records you desire to review.

Specifically, there is one set of records in which a parent sent a series of emails that discuss his special needs student in great detail. As a part of these emails, the parent also made a number of records requests, both about his student as well as about the special needs methodology that was being used with his student. Eventually, his request broadened to ask for additional records regarding his student, but also to ask for other materials he believed may be related to his student and the use of certain special needs methodologies, including the personnel file and other employment records of certain employees who were working with the student.

As a part of your October 26, 2022 clarification to the District, you specified that you were not seeking "child specific educational records". In reviewing the materials that were submitted to the parent as a part of his request, we have identified several records that we do believe are not child-specific, such as the personnel file and other employment records of the District employee who worked directly with the student in question. Thus, the District believes those records remain responsive to your request and will continue to provide them as a part of an upcoming installment. However, there are additional records, including the logs of services provided for the special needs student, logs pertaining to similar services provided to other students, correspondence between the requestor and/or other parents regarding their special-needs students, and other similar materials that we believe constitute child-specific education records and you are not seeking as a part of your request. In particular, parent correspondence that specifically is addressing a student has been approached differently by administrative and judicial authorities in certain situations in determining whether it constitutes and 'educational record'. Among the considerations that are considered is whether the student can reasonably be identified by a review of the total records provided. Additionally, the District also considers whether the records are irrevocably intertwined in nature. After reviewing these records, the District has identified that the correspondence in which students are directly or indirectly discussed regarding educational services or this specific educational program and methodology, when viewed in total, appears to be part and parcel of the underlying educational records themselves. This is due, in part, but not in all, to the fact that these records were identified, gathered, and provided as a part of a parents perceived advocacy on behalf of their student and child, and that follow up requests for additional records, as well as the follow up correspondence itself and the records and correspondence that were responsive to the parents underlying requests, again, were all generated as a part of the parent's efforts to discuss their student's educational programming and advocate that certain steps be taken for their student.

As noted above, the District does not believe additional clarification is needed at this time but wanted to apprise you of its approach to this particular set of records in case you do believe additional clarification is warranted or have any other questions regarding the above. If you do have any such questions regarding these records or believe additional description may be needed for these records for you to make an appropriate assessment please feel free to let us know.

In the meantime, we will continue processing your request. We do now believe we are approaching the end of your request and anticipate releasing an installment in a few weeks and providing you with the final batch of records within the next few installments, if not sooner.
