Pursuant to the California Public Records Act, I hereby request the following records:
Any documents and/or records related to the following rule stated on your website:
"If your birth or death certificate was issued by a city- or county-level agency and has the signature of a Health Officer or County Registrar (e.g. Local Registrar, Registrar of Vital Records), prior to presenting to our office for authentication, one of the following will be required:
have that birth or death certificate certified by the county clerk’s office in the county in which it was issued, or
obtain a certified copy of that birth or death certificate from the county recorder or State of California Department of Public Health."
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Thank you for contacting the California Secretary of State with your California Public Records Act request for information pertaining to the source of authority for the authentication of death records.
For the reasons stated below, we do not have any documents to provide pursuant to your request.
The information on our website is a summary of a combination of California and federal law. The California Secretary of State is a Competent Authority under the The Hague Convention<https://www.hcch.net/en/instruments/conventions/specialised-sections/apostille>, of which the United States of America is a member. The California Secretary of State is permitted to issue an apostille for public documents, such as birth certificates or acknowledgments of notaries public to be used abroad and authenticates signatures of California public officials whose oaths of office are on file with the Secretary of State pursuant to Government Code sections 1363<https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?sectionNum=1363.&lawCode=GOV> and 8213<https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?sectionNum=8213.&lawCode=GOV>.
California Local Heath Officers and Local Registrars do not file their oaths of office with the California Secretary of State's office; therefore, documents signed by these individuals must first be certified by the county clerk's office prior to presenting to our office for authentication. Additionally, Birth and Death Certificates are not made a matter of record with this office. (See generally California Evidence Code sections 1400-1605.)

If you are seeking information about the total cost for receiving copies of all public official oaths in our possession, please be advised that there are approximately 356,800 records maintained by two different Divisions of the Secretary of State. The copy fee is $1.00 per record. Most of not all individual oaths are one page in length. Therefore, the estimated copy cost is $356,800, which must be remitted prior to providing copies. Additionally, due to the large volume of records with, it will take several months to provide copies once payment is received.
