Pursuant to RCW Ch. 42.56 (Public Records Act), I hereby request a copy of all records or portions thereof pertaining to, or containing the following:

1. All records regarding the purchase of, acquisition of, installation of, subscription to, payment for, or agreements concerning software designed to access information from social media services;

2. All records that contain any information about the functioning of software designed to access information from social media services that is used or has been used by the Seattle Police Department;

3. All records regarding correspondence about or with a company that offers software designed to access information from social media services, including but not limited to all correspondence about or with the companies Brightplaent, Geofeedia, Intrado Inc, LifeRaft, Magnet Forensics, Media Sonar, Signal Corporation, and ZeroFOX;

4. All records regarding the policies that govern access to or use of software designed to access information from social media services;

5. All training materials and all records used to instruct members of your agency in the proper use of software designed to access information from social media services or of the information such software is capable of accessing;

6. All records regarding the sharing with entities outside the Seattle Police Department of information obtained from or obtained by using software designed to access information from social media services;

7. All records referencing social media profiles, comments, posts, messages, or events accessed or retained from social media services through use of software designed to access information from social media services.

The requested documents will be made available to the general public through the public information service MuckRock.com, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

This letter is in response to your public disclosure request dated January 28, 2016 and received by the Seattle Police Department’s Public Disclosure Unit on January 28, 2016 for all records pertaining to Social Media Services.
Pursuant to RCW 42.56.520, this is notification that we have received your public disclosure request, and we anticipate it may take up to 6 weeks from the date of this notification to respond. Therefore we anticipate a response to you on or about March 17, 2016.

This additional time is used to research this request, collect responsive records, and/or prepare records for dissemination. Please note: Seattle Police Department currently receives approximately 4,000 public disclosure requests annually.

This concerns your public disclosure request dated January 28, 2016, requesting all records pertaining to social media services.

In an effort to reduce the SPD Public Disclosure Unit’s backlog that has resulted from an unprecedented increase in the volume and complexity of PRA requests SPD has received in the past year, we have distributed requests among SPD staff who do not normally respond to requests. I will be responding to your request (P2016-417).

While the due date currently assigned to the request was June 7, 2016, I will not be able to provide you the response until on or about July 15, 2016. I apologize for any inconvenience that this may cause you. Due to the inconvenience, SPD will be waiving fees in connection with this request.

I apologize for the delay. Attached, please find the second installment of records – the Babel Street 1.5 purchase order and a set of emails. Please note: The Seattle Police Department tested Dataminr, but were never paying customers. The Department had test accounts that ended in July and did not purchase access following the test, but the company mistakenly failed turn the test accounts off.

I anticipate providing you with the third installment of records on or about December 5, 2016.

I again apologize for the delay in responding to you. With the use of GovQA, our electronic PDR tracking system, several old PDRs fell through the cracks. Yours was one of them.

Please find the 3rd installment of records responsive to your request. In addition, I have a 1200 + page installment ready for release; however it contains the identity and contact info of FBI employees. Are you okay with the redaction of the names and contact info of these FBI employees. No you are not, I will have to provide the FBI third party notice so that they have time to file an injunction. If you are okay with the redactions, I will be able to provide you the records immediately.

Please let me know ASAP. I anticipate providing you with the fourth instalment on or about May 24, 2017.
