Pursuant to the Oklahoma Open Records Act, I hereby request the following records:

- Policies and procedures related to the initial collection of sexual assault evidence collection kits.
- Number of sexual assault evidence collection kits submitted to the Oklahoma State Bureau of Investigation from Jan. 1, 2000 to the date this request is processed
- Number of untested sexual assault evidence collection kits submitted to the Oklahoma State Bureau of Investigation from Jan. 1, 2000 to the date this request is processed
- Number of tested sexual assault evidence collection kits submitted to the Oklahoma State Bureau of Investigation from Jan. 1, 2000 to the date this request is processed
- Number of sexual assault evidence collection kits submitted to the Oklahoma State Bureau of Investigation from Jan. 1, 2000 to the date this request is processed for a crime that happened on a Native American reservation
- Policies and procedures regarding the timeframe of the collection and testing of sexual assault evidence collection kits including the timeframe required for sexual assault evidence collection kits testing by the examiner (also known as “sexual assault examiners”, “sexual assault nurse examiners”, or “sexual assault forensic examiners”).
- Policies and procedures regarding the maintenance and transfer of sexual assault evidence collection kits.
- Policies and procedures related to the process of checking the status of a sexual assault evidence collection kits and the notification provided to survivors regarding their sexual assault evidence collection kits.
- Policies and procedures regarding the statute of limitations for maintenance and or storage of sexual assault evidence collection kits, both tested and untested.

Should your agency believe that any additional data, statistics, reports, policies, procedures, or other analysis pertaining to the collection, maintenance, transfer, and disposal of sexual assault evidence collection kits (also known as “sexual assault kit”, “sexual offense evidence collection kit”, “sexual assault forensic evidence kit”, “physical evidence recovery kit”, “rape test kit”, or “rape kit”), or any related issues may reside with another agency or agencies, indication of such agencies would be greatly appreciated.

Attached is the OSBI response to your request of March 8, 2018. Due to a database conversion in 2009, the OSBI cannot provide you statistics for "no test" reports as far back as 2000 as requested. Such statistics have been provided from 2009 to date.

The OSBI maintains an accredited forensic laboratory to provide forensic scientific assistance to Oklahoma law enforcement agencies. 100% of sexual assault kits submitted to the OSBI forensic laboratory are assigned to laboratory personnel for appropriate analysis and report. At times, the OSBI receives notice from the submitting agency that analysis of the SA kit is no longer needed and a "no analysis" report is written. The records provided indicate that there were 177 such "no analysis" reports written the near-decade comprised of CY2009 to present.
