Subject: FOIL Request for Records that refer to 484 Broadway, NY, NY

Dear Mr. Paasewe:

Pursuant to the New York Freedom of Information Law, I hereby request any records that refer to:
1) the building and/or property located at 484 Broadway, NY, NY;
2) any Establishment located at 484 Broadway, NY, NY;
3) any owner of 484 Broadway, NY, NY;

This record request includes, but is not limited to, any records that relate to the any investigation by the Division of Human Rights ("Division") into storefront accessibility at 484 Broadway, NY, NY. (For example, the investigation referenced in a press release dated, June 27, 2017
located on the Division's website at the following address: https://dhr.ny.gov/storefront-accessibility .)

As used in this record request the term"Establishment" means, and includes, but is not limited to, i) the J.Crew store, J.Crew Inc., Grace Holmes, Inc., J.Crew Retail Stores, and ii) any merchant, retailer, store owner, store, franchise, franchisor, franchisee, retail tenant, or leaseholder.

In addition, I kindly refer you to the definition of records found in §86 (4) of Public Officers Law, Article 6 (the "Freedom of Information Law"):
"Record" means any information kept, held, filed, produced or reproduced by, with or for an agency or the state legislature, in any physical form
whatsoever including, but not limited to, reports, statements, examinations, memoranda, opinions, folders, files, books, manuals, pamphlets,
forms, papers, designs, drawings, maps, photos, letters, microfilms, computer tapes or discs, rules, regulations or codes.

Lastly, please recall that under the Freedom of Information Law all records are presumed to be available pursuant to a request for records, unless a specific exemption applies. And to the extent an exemption applies, such exemption must be narrowly construed, and any records or parts thereof to which the exemption does not specifically apply, must be disclosed. As the New York State Committee on Open Government has explained "[s]tated differently, all records of an agency are available, except to the extent that records or portions thereof fall within one or more grounds for denial appearing in §87(2)(a) through (l) of the [Freedom of Information] Law".

Thank you in advance for your anticipated cooperation in this matter.

In the event that there are fees due to fulfill my request, please inform me if the total charges will exceed $200 in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I look forward to receiving your response to this request within 5 business days, as the statute requires.
