Because there are two distinct legal entities' records being requested, and the Legal Names of the entities are identical other than a comma, it is crucial that the produced records from one entity are not confused or mixed with the other entity's records.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

Due to the non-commercial nature of this request, and due to the records being vital to trust in the Public Health system, I would be grateful if you would waive any fees associated with this request. If there are fees, I would appreciate if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, in a searchable format such as PDF, transmitted to me by e-mail attachment if possible, or by CD-ROM if not.

Good afternoon,

Staff have performed a preliminary review and it is estimated that it will
take approximately 15.50 hours of staff time to retrieve and review the
requested records. The estimated minimum cost associated with fulfilling
this portion of the records request is $435.00 ($30 per hour after the
first hour) in accordance with the Department’s Open Records Act policy.

If you authorize these charges, please take the following actions:

1.

Notify us by email at cdphe.recordsrequests@state.co.us, and
2.

Submit your payment online <https://cdphe.colorado.gov/payrevenue> and
provide us a copy of your payment confirmation receipt. (Use “Records-OLRC”
as both the Customer Number/Reference ID and Invoice Number when
entering the required information)

Upon receipt of payment, staff will begin compiling the response. It may
be that this work can be accomplished in less than 15.50 hours; if this is
the case, the applicable portion of your deposit will be returned to you.
It may be that, upon further review, staff will determine that additional
document retrieval and/or review time is needed to respond to your
request. If that is the case, the Department will notify you prior to
performing the work.

During the review it may be determined that certain records or portions of
records are confidential or exempt from release. This estimate does not
include time and costs for creating a privilege log for records that are
not released. Creation of a privilege log is charged based upon actual
cost. If privileged records are identified and a privilege log was
requested, the Department will contact you regarding the estimated charges
prior to performing the work.

Thank you for the prompt reply and cost analysis. Can staff time can be reduced by limiting the request to the years 2005-2008? If so, we would like an updated estimate of the fees. If not, we will consider the current estimate and follow up on this request accordingly.

We were able to locate evidence of a file for the Public Water System that dates back to at least November 2007. The message is attached for your reference, as an example of the correspondence we seek. We are seeking all correspondence and other records for the time period leading up to the assignment of a PWSID# in 2017.

We believe the most valuable Public Records are those between the years 2005-2017. May we please update our request to limit the two sets of records requests to this time period and get an updated cost estimate?
