I have attached two PDF files to this email. They contain the logs the
Office has maintained of records requests it received from 5-12-14 through
4-21-15, the date your request was received. One of them covers the time
period of 5-12-14 through 12-31-14. It is named “Records request log

001 through 004. The other covers the time period of 1-1-15 through

As I mentioned to you in my email of 6-12-15, the Office does not have a
single log containing all the data fields described in your request. The
PDF files you are being provided today, however, contain the most
responsive records the Office has for the time period they cover. Your
request is granted with regard to the records contained in those PDF
files. You will note that some of them contain redactions to protect
privacy interests.

When the Office has finished the remainder of its processing of your
request, I will send you its completed response. That final, completed

After reviewing all the records I have been able to locate that are
potentially responsive to your request, I have determined that the Office
does not have an official log of records requests beyond the logs I sent
you on 8-12-15. Instead, there are various incomplete records that are in
the nature of drafts, and are not responsive to your request.

It may be helpful to you to know that effective 5-12-14, the Office created
a new position, that of Government Records Counsel. I was designated to
serve in that position and have done so continuously since the position was
created. Among other things, I am responsible for taking the lead in
responding to government records requests made to the Office. The logs I
provided to you on 8-12-15 are logs I began keeping when I began my duties
as Government Records Counsel. Before then, we did not have the
centralized approach that we now have.

Even though the Office does not have an official log of records requests
for the time periods before 5-12-14, I recognize the value of having such a
log. During the next several weeks the Office will be hiring a legal
assistant to help me with records requests. I intend to ask that legal
assistant to take the records we have and work on putting together an
official log. Please be aware that the law does not require us to create a
record. See Utah Code Ann. Section 63G-2-201(8)(a)(i) (West Supp. 2015).
However, for the reasons I have explained, I intend to make that effort. I
do not know how far back in time we will be able to go on the log, but we
will do our best. When the log is completed I will provide you the
information I can.

It will be a time consuming process to prepare such a log, and we are still
processing numerous other records requests. As is further explained below,
I am extending our response deadline to 11-20-15. In the meantime, your
patience and understanding will be appreciated.

As I mentioned above, it is necessary to extend the deadline to provide an
additional response to your request. The response deadline is therefore
being extended as authorized by Utah Code Sections 63G-2-204(5)(d) and
63G-2-204(6)(c) (West Supp. 2015). Pursuant to Utah Code Ann. Section

far. It has become clear that our idea of creating an additional record is
unrealistic and not feasible, given our limited resources of time and
personnel. It is time to bring closure to the processing of your request.
Accordingly, I am notifying you that we have already provided you with all
our responsive records and we will not be creating any new records.

As you know, we redacted some information from the logs I provided you on
August 12, 2015. Any redactions we made were done to protect privacy
interests when we felt that disclosure of the information redacted would
constitute a clearly unwarranted invasion of the personal privacy of an
individual. That information is private. Utah Code Ann. Section
63G-2-302(2)(d)(West Supp. 2015).
