Pursuant to Utah’s Government Records Access and Management Act (“GRAMA”), I hereby request the following records:

A log of public records requests submitted to the Attorney General's office that lists the date of request, the requester's name, the requester's organizational affiliation, a description of the request and the date the request was filled. Ideally I would like this information for the period from 2004 to the present.

The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, and is made in the process of academic research and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

To Whom It May Concern:

I wanted to follow up on the following Freedom of Information request, copied below, and originally submitted on April 6, 2015. Please let me know when I can expect to receive a response, or if further clarification is needed.

Thank you for your help.

Dear Mr. Peterson,

The Utah Attorney General’s Office received your 4-21-15 email bearing the
subject line: “Freedom of Information Request: Public Records Request Log -
Utah Attorney General’s Office.”

In your email, you state that you submitted the same request to our office
on 4-6-15. I am sorry but we do not have record of receiving the request
at that earlier time.

Under the circumstances I have logged in your request as of the date we
received it, namely, 4-21-15. It has been assigned #15-47. The response
is due 5-5-14, but because we are currently swamped with records requests I
anticipate that it will be necessary to extend that deadline. If that
happens, I will notify you.

For your information, in case you ever submit a future records request to
our office, the following are the addresses for you to use in doing so:

Your request seeks the following records:

“A log of public records requests submitted to the Attorney General’s

requester’s organizational affiliation, a description of the request and
the date the request was filled. Ideally I would like this information for

The Office is working on its response to your request. Unfortunately, the
Office is currently processing a large number of records requests, and it
will not be possible to respond to your request by today. The response
deadline is therefore being extended as authorized by Utah Code Sections
63G-2-204(5)(d) and 63G-2-204(6)(c) (West Supp. 2014). Pursuant to Utah
Code Ann. Section 63G-2-204(3)(b)(iv) (West Supp. 2014), I am notifying you
that I am hopeful that the Office will be able to respond to your request
by 6-12-15. If at some future date it appears that further extension of
that deadline is needed I will inform you. Your patience is appreciated.

You have the right to appeal this extension of the response deadline to the
chief administrative officer of the Office, as provided in Utah Code Ann.
Section 63G-2-401(1)(b) (West Supp. 2014). The notice of appeal would need

Dear Mr. Peterson,

The Utah Attorney General’s Office is continuing to work on its response to
your 4-21-15 email bearing the subject line: “Freedom of Information
Request: Public Records Request Log - Utah Attorney General’s Office.”
This email will give you a status update and further extend the response
deadline.

Your request seeks the following records:

“A log of public records requests submitted to the Attorney General’s
Office that lists the date of request, the requester’s name, the
requester’s organizational affiliation, a description of the request and
the date the request was filled. Ideally I would like this information for
the period from 2004 to the present.”

The Office does not have a single log containing the data fields described
in your request. It does have some records that will be at least partially
responsive to your request, and I am in the process of gathering those
records. Unfortunately, the Office has become even more swamped with
records requests since I last corresponded with you, and it will not be
possible to respond to your request by today. The response deadline is
therefore being extended as authorized by Utah Code Sections
63G-2-204(5)(d) and 63G-2-204(6)(c) (West Supp. 2014). Pursuant to Utah
Code Ann. Section 63G-2-204(3)(b)(iv) (West Supp. 2014), I am notifying you
that I estimate that the Office will be able to respond to your request by
7-16-15. If at some future date it appears that further extension of that
deadline is needed I will inform you. Your patience is appreciated.

You have the right to appeal this extension of the response deadline to the
chief administrative officer of the Office, as provided in Utah Code Ann.
Section 63G-2-401(1)(b) (Effective 5-12-15). The notice of appeal would

From: Blaine Ferguson

Dear Mr. Peterson,

Thank you for your email of this morning.

The Utah Attorney General’s Office is working to conclude the processing of
its response to your records request (#15-47).

Unfortunately, however, because the Office continues to be processing
numerous records requests, it will not be possible to respond to your
request by today. The response deadline is therefore being extended as
authorized by Utah Code Sections 63G-2-204(5)(d) and 63G-2-204(6)(c) (West

Supp. 2014), I am notifying you that I estimate that the Office will be
able to respond to your request by 8-12-15.

As explained in previous emails, you have the right to appeal this
extension of the response deadline to the chief administrative officer of
the Office, as provided in Utah Code Ann. Section 63G-2-401(1)(b)
(Effective 5-12-15). For your information, however, I do not anticipate
that further extension of the deadline will be needed. Thank you for your
patience and understanding.

From: Blaine Ferguson

Dear Mr. Peterson,

The Utah Attorney General’s Office is continuing to work on its response to
your records request (#15-47), which asks for the following records:

“A log of public records requests submitted to the Attorney General’s
Office that lists the date of request, the requester’s name, the
requester’s organizational affiliation, a description of the request and
the date the request was filled. Ideally I would like this information for
the period from 2004 to the present.”

As the result of an extension, the response to your request is due 8-12-15.

I had hoped to conclude the Office’s response to your request by that date,
but because of the numerous records requests we are processing, that has
not been possible. However, I am providing you today with a partial
response to your request, even though a further extension is needed to
respond to the remainder of your request.

I have attached two PDF files to this email. They contain the logs the
Office has maintained of records requests it received from 5-12-14 through
4-21-15, the date your request was received. One of them covers the time
period of 5-12-14 through 12-31-14. It is named “Records request log
(5-12-14 through 12-31-14)_Redacted.” Its pages have been Bates numbered
001 through 004. The other covers the time period of 1-1-15 through
4-21-15. It is named “Records request log (1-1-15 through
4-21-15)_Redacted.” Its pages have been Bates numbered 001 through 003.

As I mentioned to you in my email of 6-12-15, the Office does not have a
single log containing all the data fields described in your request. The
PDF files you are being provided today, however, contain the most
responsive records the Office has for the time period they cover. Your
request is granted with regard to the records contained in those PDF
files. You will note that some of them contain redactions to protect
privacy interests.

When the Office has finished the remainder of its processing of your
request, I will send you its completed response. That final, completed
response will provide an explanation as to why any particular records have
not been provided to you, or why any redactions have been made. You will
then have an opportunity to appeal if you are aggrieved by the Office’s
access determination. You will be notified at that time regarding your
appeal right.

As I mentioned above, it is necessary to further extend the deadline to
respond to the remainder of your request.
2014), I am notifying you
that I estimate that the Office will be able to respond to your request by
9-11-15. I am hopeful that no further extension of the deadline will be
needed. Your patience is appreciated.

You have the right to appeal this extension of the response deadline to the
chief administrative officer of the Office, as provided in Utah Code Ann.
Section 63G-2-401(1)(b) (Effective 5-12-15). The notice of appeal would
need to be sent to Attorney General Sean D. Reyes at following address:

Great, thanks for sending the initial batch of records.

I look forward to receiving the rest when you a chance.

From: Blaine Ferguson

Dear Mr. Peterson,

On 8-12-15, I provided you with a partial response of the Utah Attorney
General’s Office to your records request (#15-47), which asks for the
following records:

“A log of public records requests submitted to the Attorney General’s
Office that lists the date of request, the requester’s name, the
requester’s organizational affiliation, a description of the request and
the date the request was filled. Ideally I would like this information for
the period from 2004 to the present.”

This email will provide you with a status report and will extend the
response deadline.

After reviewing all the records I have been able to locate that are
potentially responsive to your request, I have determined that the Office
does not have an official log of records requests beyond the logs I sent
you on 8-12-15. Instead, there are various incomplete records that are in
the nature of drafts, and are not responsive to your request.

It may be helpful to you to know that effective 5-12-14, the Office created
a new position, that of Government Records Counsel. I was designated to
serve in that position and have done so continuously since the position was
created. Among other things, I am responsible for taking the lead in
responding to government records requests made to the Office. The logs I
provided to you on 8-12-15 are logs I began keeping when I began my duties
as Government Records Counsel. Before then, we did not have the
centralized approach that we now have.

Even though the Office does not have an official log of records requests
for the time periods before 5-12-14, I recognize the value of having such a
log. During the next several weeks the Office will be hiring a legal
assistant to help me with records requests. I intend to ask that legal
assistant to take the records we have and work on putting together an
official log. Please be aware that the law does not require us to create a
record. See Utah Code Ann. Section 63G-2-201(8)(a)(i) (West Supp. 2015).
However, for the reasons I have explained, I intend to make that effort. I
do not know how far back in time we will be able to go on the log, but we
will do our best. When the log is completed I will provide you the
information I can.

It will be a time consuming process to prepare such a log, and we are still
processing numerous other records requests. As is further explained below,
I am extending our response deadline to 11-20-15. In the meantime, your
patience and understanding will be appreciated.

As I mentioned above, it is necessary to extend the deadline to provide an
additional response to your request. The response deadline is therefore
being extended as authorized by Utah Code Sections 63G-2-204(5)(d) and
63G-2-204(6)(c) (West Supp. 2015). Pursuant to Utah Code Ann. Section
63G-2-204(3)(b)(iv) (West Supp. 2015), I am notifying you that I estimate
that the Office will be able to respond to your request by 11-20-15.

You have the right to appeal this extension of the response deadline to the
chief administrative officer of the Office, as provided in Utah Code Ann.
Section 63G-2-401(1)(b) (West Supp. 2015). The notice of appeal would need
to be sent to Attorney General Sean D. Reyes at following address:

From: Blaine Ferguson

Dear Mr. Peterson,

I am writing regarding your records request to the Utah Attorney General’s
Office (#15-47), which asks for the following records:

“A log of public records requests submitted to the Attorney General’s
Office that lists the date of request, the requester’s name, the
requester’s organizational affiliation, a description of the request and
the date the request was filled. Ideally I would like this information for
the period from 2004 to the present.”

This email will provide you with our final response to your request.

As I informed you in my email of 9-11-15, the Office does not have an
official log of records requests beyond the logs I sent you on 8-12-15.
Instead, there are various incomplete records that are in the nature of
drafts, and are not responsive to your request. The records I sent you on
8-12-15 are all of the responsive records the Office has to your request.

As I have explained in my earlier correspondence to you, even though the
law does not require us create a record, we had intended to hire a legal
assistant whose duties would include trying to prepare an official log that
would go back to earlier time periods than the logs I have provided you.
Unfortunately, our plan of hiring a legal assistant has not worked out so
far. It has become clear that our idea of creating an additional record is
unrealistic and not feasible, given our limited resources of time and
personnel. It is time to bring closure to the processing of your request.
Accordingly, I am notifying you that we have already provided you with all
our responsive records and we will not be creating any new records.

As you know, we redacted some information from the logs I provided you on
August 12, 2015. Any redactions we made were done to protect privacy
