Pursuant to North Dakota Constitution, Article XI, Section 6, and the North Dakota Open Records Statute, N.D.C.C. § 44-04-18(1), I hereby request the following records:

A log of public records requests submitted to the Attorney General's office that lists the date of request, the requester's name, the requester's organizational affiliation, a description of the request and the date the request was filled. Ideally I would like this information for the period from 2004 to the present.

The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, and is made in the process of academic research and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I am responding on behalf of the Attorney General to your email requesting “a log of public records requests submitted to the Attorney General's office.” The record you requested cannot be provided because no such record exists. This office does not maintain a log of public record requests. In fact, under North Dakota’s open records laws, a public entity cannot require a requester to provide a name or other identifying information or complete a form as a condition of receiving records. A request for records can be made by phone, email, fax, letter, or in person (see: http://www.ag.nd.gov/Brochures/FactSheet/OR-OMGuide.pdf). This office does not log in person and telephone requests for records or those received via email.

Where we have received a written request for records via snail mail, it is logged as general correspondence along with all other general correspondence received by this office, and discarded after 12 months pursuant to our agency’s record retention schedule.
