8(c) Identity of Subject of Unsustained Employment Investigation of Highly Offensive Allegation - RCW 42.56.230(3), RCW 42.56.240(1) Explanation: The identity of the subject of an unsustained employee misconduct investigation is exempt when disclosure would violate that employee’s right to privacy. The subject’s right to privacy would be violated in this case because of the highly offensive nature of the allegations.
If however you would like to exclude the employee names and ID numbers, then we would be able to release the report to you right away and without the necessity of third party notification and review of the unsustained OPA allegations.
Please advise on how you would like SPD to proceed. If no response is received within 5 business days, we will assume you want us to move forward with providing third party notification.

Hello,

In your previous communication, you indicated that I should expect the responsive records today March 29. I wanted to check on the status of my request, and to see if the records are ready to release or if there was a new estimated completion date.

Your communication from November 2020 indicated that employee notification must be provided before the IAPro report can be released. Section 3.6K of the SPOG contract requires mail notification at least 5 days prior to the release of personally identifying information as pertains to disciplinary/OPA files. As it has been four months since that communication, I would assume that employee notification has been completed.
