This email is to provide you with a status update regarding your public disclosure request dated January February 13, 2016 and received by the Seattle Police Department’s Public Disclosure Unit on February 16, 2016 for the listing of OPA allegations in IAPro.

We are still processing your request. After review of your request, we anticipate it may take up to 12 weeks from the date of this notification to respond. Therefore, we anticipate a response to you on or about June 28, 2016.

This additional time is used to research this request, collect responsive records, and/or prepare records for dissemination. Please note: Seattle Police Department received more than 13,000 public disclosure requests in 2015.

Please be aware, we are required to provide third party notice to all employees who will be affected by your request. This notice will advise the individuals, that they have the legal right under RCW 42.56.540 to bring legal action in King County Superior Court to enjoin the release of any records they believe may not be subject to disclosure. As the requestor, you would be a necessary party in such a third party action under RCW 42.56.540. Burt v. Dep't of Corrections, 168 Wn.2d 828, 231 P.3d 191 (2010).

Dear Mr. O’Dell,

This email is in response to your public disclosure request dated February 13, 2016 and received by the Seattle Police Department’s Public Disclosure Unit on February 16, 2016 for the listing of OPA allegations in IAPro.

Attached as your first installment of records is an Excel spreadsheet containing the sustained and unsustained allegations in IAPRO. We are still reviewing the OPA allegations which are deemed as supervisor actions and will provide you with the list in the next installment of records.

The identities of officers who were the subject of investigations of allegations of a highly-offensive nature have been redacted on pages 1-4, 5-10 and 12
Statutory exemption: RCW 42.56.230(3), which exempts “personal information in files maintained for employees, appointees, or elected officials of any public agency” are exempt from public inspection and copying “to the extent that disclosure would violate their right to privacy.”
Explanation: The records are in files maintained for employees of SPD and the nature of the unsustained allegations are highly offensive. Disclosure of the employee's identity in connection with the unsubstantiated allegations of a highly-offensive nature would violate that right. See West v. Port of Olympia, 183 Wn. App. 306, 312-13, 333 P.3d 488 (2014); see also, RCW 42.56.240(1).

Please be advised that we have waived the fee for the attached responsive record. We thank you for your continued patience as we continue to review the records responsive to your request.

Dear Mr. O’Dell,

This email is in response to your public disclosure request dated February 13, 2016 and received by the Seattle Police Department’s Public Disclosure Unit on February 16, 2016 for the listing of OPA allegations in IAPRO.

Your request for a copy of a public record has been processed and the final installment of responsive records are ready for pickup at the Public Request Unit counter, 1st floor of the Seattle Police Headquarters, 610 Fifth Ave. Our hours are Monday through Friday 8:00 AM to 4:45 PM.
