Pursuant to the Maryland Public Information Act, I hereby request the Maryland State Police complete investigative file into the April 13, 2021 shooting of Peyton Ham by Trooper Joseph Azzari . This request includes but is not limited to reports of recorded statements, video surveillance or body camera footage, witness interviews, and photographs, as well as the findings of the investigation.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. Alternatively, please consider waiving any fees, pursuant to § 4-206(e)(2)(ii) of the General Provisions Article, as this request is on behalf of individuals served by the Maryland Office of the Public Defender, a state government agency, which solely serves indigent citizens of Maryland. As a result, my request for the above-listed public records is in the public interest. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Requester:

On January 12, 2022, the Maryland State Police received your request made
under the Public Information Act (Annotated Code of Maryland, General
Provisions Article §§ 4-101 through 4-601) for the information captioned
above. In response, I'm attaching a complete copy of the investigative
report.

As to the balance of your request, it will take us more than 10 working
days to produce the requested records. The delay is due to the time
required to perform a thorough search of our records and to conduct the
necessary review process. Once all of the records have been collected, they
must be reviewed to determine whether they are, in whole or in part, exempt
from disclosure under the Act. If any are to be withheld or redacted, an
explanation will be provided.

In review of this matter it appears that we will be in position to provide
you with recordings of witness interviews, body camera footage from a law
enforcement agency other than this Department (our troopers are not
equipped with body worn cameras), surveillance video, and photographs.

Note that the Maryland State Police charges a fee for copies of records at
the rate of $0.25 per page, $15.00 per audio recording, and $25.00 per
video recording. There is also a fee charged for the search, collection
and redaction of all applicable information at a rate equal to the hourly
pay of the employee(s) working to fulfill the request (first two hours
gratis). As such, the fee in this matter is as follows:

1) Investigative Record: No Charge (covered by the two hours of gratis
work)
2) Body Camera Footage: 2 hours processing time X $42.00/hr = $48.00 +
$25.00 (video recording) = *$73.00*
3) Witness Interviews: 1 hour processing time X $42.00/hr =
$42.00 + $15.00 (audio recording) = *$57.00*
4) Surveillance video: 1 hour processing time X $42.00/hr =
$42.00 + $15.00 (audio recording) = *$57.00*
5) Photographs: 6 hours (over 500 hundred photos) X
$42.00/hr = $252.00 + $15.00 (CD recording) = *$267.00*

*TOTAL
DUE $454.00*

Payment must be made before the requested information can be released. You
may make the check or money order payable to the Maryland State Police.
