Dear Custodian of Records/Public Records Coordinator,

I am collaborating with the Electronic Frontier Foundation, a public interest group, and the media organization MuckRock, to survey how law enforcement agencies deploy mobile biometric technologies.

Mobile biometric technologies can be defined as any mobile device or mobile app used by law enforcement agencies to scan, capture, analyze, store, or automatically recognize any physical or biological characteristic of a subject. Commonly used mobile biometric technologies include fingerprint/thumbprint collection, facial recognition, scans of the iris or other elements of the human eye, Rapid DNA, and tattoo recognition. (Please see below for examples.)

Pursuant to Missouri Sunshine Law and the Missouri Public Records Law, I request the following records pertaining to mobile biometric technologies, including those listed above, as well as other biometric technologies I have not identified:

1) Purchasing and procurement documents, including but not limited to: purchase orders, RFPs, responses to RFPs, invoices and contracts

2) Policy, procedural, and training documents, including but not limited to: use policies, standard operating procedures, training materials, presentations, privacy assessments, data retention policies, and other guidelines

3) Programming documents, including but not limited to: funding opportunity announcements, grant applications and grantor status/progress reports, reports to legislative bodies, annual reports

4) Audit documents, including but not limited to: audits of the system, misuse reports, and reports to oversight bodies

In your response, I would appreciate that you individually address each of the above categories of documents individually.

In addition to the above classes of documents, I am also seeking the following information:

- The total number of individuals whose biometric data has been collected over the last three years,
- The total number of [biometric data points] contained in the agency’s database
- The retention period for biometric data
- The number of mobile biometrics devices purchased and in use
- The total number of authorized users of the mobile biometrics devices
- Which external agencies and entities have access to biometric data in the database and under what conditions,
- Whether biometric data is combined with biographic data such as name and address in the database, and
- The process by which data is entered into the database

These documents will be published online and inform the public dialog over police technology. Because of the great public interest in these issues, I ask that you waive any fees. If your agency is unable to do so, please contact me with an estimate of the costs.

Thank you.

Sincerely,

Michael Morisy

Mr. Morisy;

Can you please advise what years you would like the request to cover. Further, are you including annual maintenance agreements in your request or only the equipment?

Please be advised, fees will not be waived for this request. This request will require a large amount of time and resources to locate, review and copy the information.

Based on what one person has spent on this already, an approximately estimate would be $200 to $300. Again, that's an estimate and it could be higher or lower depending on the time frame and amount of information requested.

Please respond to this email as soon as possible so that we may continue processing your request. Per §610.026.2, payment may be requested prior to the making of the copies.

I look forward to your response. Thank you.

A fix is required to perfect the request.

From: Michael Morisy

Thank you for responding to our request.

To answer your initial questions:

We are specifically interested in technology currently in use by the Kansas City Police Department. To that extent, the years are not the key filter, since we are not interested in purchases of technology that has been decommissioned or abandoned. In terms of maintenance agreements, we would be willing to narrow this to the current fiscal year and the year prior to this fiscal year.

However, we are interested in further narrowing our request in order to conserve resources both for your agency and on our end.

This could be achieved two ways:

First, your office could let us know which of the specified technologies are currently used by your agency, and we can further reduce the scope of our request based on that information.

Alternately, we could narrow our request to just policies/standard operating procedures for these technologies. If, after receiving that information, we can file new requests if more information is required.

Please let us know if either of these options would be appropriate for your department.

Mr. Morisy:

I’m going to refer you to Sgt. Jacob Becchina who will have some information related to facial software. In checking with other units, divisions, etc., I’m not locating any other “mobile biometric technology” we are currently using. My understanding with the facial recognition software is that we’re getting ready to decommission this as it has not been used for quite a while. Mr. Becchina should be able to answer any questions you have. Even though this isn’t anything we still technically use, if you so desire information after speaking with Mr. Becchina, please let me know. I know in your follow up you only wanted technology “currently in use.” It has been explained to me that while we have had this, we no longer use it and it’s simply a formality in terms of when it is officially decommissioned.

His number is 816-889-6129.

If you have any questions for me, please do not hesitate to contact me.

Mr. Morisy,
I have received the below information request from Jamie Brown,
The very short short answer is that we do not currently have a facial recognition program.
The program we used in the past was a free open source program and it will only function on Windows 2003 or older, which is not supported in current CJIS requirements.
We have not identified funding for an optimal facial recognition program that meets those CJIS requirements.
Our computer support unit is in the process of off loading the data to a server for storage in the event we ever do purchase facial recognition software in the future.

Let me know how I can help more in the future
Sgt Jake Becchina
