I would like to obtain all emails sent to, from, or copied to Mike Pence from January 1, 2014 to Present day containing any of the following non-case-sensitive key-strings: "EB-5", "EB5", "Regional Center", or "USCIS".

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I respectfully appeal this decision. Your quote is in reference to a subpoena and not related to the Indiana Access to Public Records Act.

Furthermore, other Indiana agencies, state agencies, cities, and federal agencies have all determined via appropriate interpretation of the statute and case law that the search for records via keystrings is not unreasonable, in fact, doing a record search via keystrings is more easily done and more precisely described than searching paper files.

Could you please accept this as my appeal and re-evaluate the response.

To whom this may concern,

I disagree, the records requested are precisely described in a manner that is easily translated into an electronic email search. The act of searching electronic records, specifically emails, is something that almost every public employee knows how to do and likely does on a daily basis.

Further, the Supreme Court case that you cited has to do with a "subpoenaed party" and not the Access to Public Records Act (“APRA”) (Ind. Code 5-14-3).

Please let me know if you have any questions, I do not believe there is any valid reason to deny these documents and similar requests have been successfully completed by other state agencies.
