Pursuant to the Maine Freedom of Access Act ("FOAA"), I hereby request the following records:

Training plans submitted by Maine Police Departments and Emergency Services Units to the Department of Defense's ME state coordinator, Mr. Steven Buck, for the use of 1033 equipment and vehicles - as described in the below statement from Michelle McCaskill, spokesperson for the Defense Logistics Agency:

"It has always been the responsibility of each state’s designated coordinator to ensure that each and every Law Enforcement Agency (LEA) is trained on the equipment they received from the 1033 program. LEAs are required to certify to DoD through the state coordinator they have a training plan for an asset that requires specialized training, to include armored vehicles and aircraft, before the equipment is issued. LESO receives a copy of the plan only – the approval process is at the state coordinator level."

If any supplementary training material was included with the proposal (e.g. a powerpoint such as this: https://s3.amazonaws.com/s3.documentcloud.org/documents/2162544/responsive-documents.pdf), please consider this within the parameters of the request. With each training plan submitted by an Emergency Services Unit, please also provide any documents that list the participating police agencies and/or which departments house the vehicles and equipment that require training.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by 1 M.R.S.A. § 408(6). The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Mr. Welch, I responded to this request once already. I received it for the the first time on September 29th, 2015. Up until that time your requests were being screened out by our SPAM filter and were not being seen. In that response I included the same documents I have attached here.

The State of Maine has 3 agencies with MRAP vehicles assigned and they are Sanford PD, South Portland PD, and the Cumberland County Sheriff’s Office. Each of these agencies have properly complied with DoD and DLA rules for the special assignment of such a vehicle. South Portland PD and the Cumberland County Sheriff’s Office drafted two documents each outlining each agency’s Policy and Training separately as it concerns the MRAP. Sanford PD drafted a single document outlining both that agencies policy and training regarding the MRAP.

The above mentioned documents are attached to this email. These are the only records required by DLA / LESO / DoD regarding the assignment of these vehicles and are the only media retained by this office in regard to them. My office does not retain any photographs, powerpoints, spreadsheets, or other electronic media in regard to this equipment.
