Pursuant to the Kentucky Open Records Act, I hereby request the following records:

A log of city open records requests received by the City of Louisville between January 1, 2018 and December 31, 2018, including for each request the subject of the request, the requester's name, and the final disposition of the request.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

According to your company website, this is a commercial purpose request. Per KRS 61.870(4)(a) a Commercial Purposes request is defined as “…the direct or indirect use of any part of a public record or records, in any form, for sale, resale, solicitation, rent, or lease of a service, or any use by which the user expects a profit either through commission, salary, or fee.” Fee’s charged by Metro department’s vary, see below for a breakdown of hourly charges. Please complete, notarize and return the attached form via email (you don’t have to mail the original form back if you have emailed it) to move forward with your request.

Muckrock is not my website, it is a service I am using to facilitate the request and host responsive documents.

Good morning,

I came across your response to Robin when I was looking for missed requests and I can’t tell if you’ve been responded to or not so I will explain why the request is being viewed as commercial one on our end.

On the Muckrock website’s about page<https://www.muckrock.com/about/> it mentions a $20 fee to file up to four requests (see attached). It appears that Muckrock is being paid to provide the record.

A Commercial Purposes request is defined, per KRS 61.870(4)(a), as “…the direct or indirect use of any part of a public record or records, in any form, for sale, resale, solicitation, rent, or lease of a service, or any use by which the user expects a profit either through commission, salary, or fee.”

That is why we feel that this is a commercial request.

Thank you and to be clear we do not have any issues with the content of Muckrock requests we are just under the impression that Muckrock is being paid to provide these records because of the $20 fee listed on the site and referenced in the attachment.
