Pursuant to the Kansas Open Records Act (K.S.A. 45-215), I hereby request the following records:

Training plans submitted by Kansas Police Departments and Emergency Services Units to the Department of Defense's KS state coordinator, Ms. Keri Schuetz, for the use of 1033 equipment and vehicles - as described in the below statement from Michelle McCaskill, spokesperson for the Defense Logistics Agency:

"It has always been the responsibility of each state’s designated coordinator to ensure that each and every Law Enforcement Agency (LEA) is trained on the equipment they received from the 1033 program. LEAs are required to certify to DoD through the state coordinator they have a training plan for an asset that requires specialized training, to include armored vehicles and aircraft, before the equipment is issued. LESO receives a copy of the plan only – the approval process is at the state coordinator level."

If any supplementary training material was included with the proposal (e.g. a powerpoint such as this: https://s3.amazonaws.com/s3.documentcloud.org/documents/2162544/responsive-documents.pdf), please consider this within the parameters of the request. With each training plan submitted by an Emergency Services Unit, please also provide any documents that list the participating police agencies and/or which departments house the vehicles and equipment that require training.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

The Kansas Department of Administration has received your written record request on 4/19/2016. In accordance with K.S.A. 45-218(d), we have begun the process of determining if we possess any public records meeting the terms of your request and, as soon as possible hereafter, we will provide you with one or more of the following:

1.  Copies of the requested public records;

2.  A statement concerning our inability to locate any public records meeting the terms of your request;

3.  A request for clarification concerning the types of records or information you are seeking;

4.  Record requests that can be provided with less than one hour of staff time or less than 25 pages will be provided at no charge.  If we determine that our office possesses the public records you request,  but are voluminous, difficult to locate, and/or contain information that may be include open and closed information, we will provide you with a written estimate of the fees that we will require be pre-paid in order to pay for the actual costs associated with (a) locating and/or retrieving the public records from storage, (b) staff time spent in assisting with making copies of the records, including attorney time spent examining the records for possible closure and/or redaction, and (c) copying and mailing the requested public records; 

For requests that exceed one hour of staff time or more than 25 pages amount, the following rates shall apply.

• Copies, 25¢ per page; Mailing, 50¢ for first 5 pages, 25¢ for additional 5 page increments; FAX, 65¢ per 10 page fax. 5 cent additions per 5 cents up to 15 after that at discretion.

• Regarding staff time, there will be charged at the rate of pay for each person(s) whose time is used in order to assist and/or respond to a specific request.  This may include the time spent to access records maintained on computer facilities, review records to determine whether closure exceptions apply and/or to redact open from closed information.  Attorney time will be charged at $60 per hour. Clerical time will be charged at $18 per hour. Information Technology (IT) services will be charged at $38 per hour. 

• Additional fees may be assessed if any other costs are incurred by the Department of Administration in connection with complying with a record request may be assessed to the requester.  The agency will provide an estimate of the fees which shall be paid prior to the agency gathering the records.  However, in order to assure payment, the final cost of providing access to or furnishing copies must be paid before the records are provided. If the final cost is less than the estimate, the requestor will be reimbursed for the difference.

5.  If we determine that we do possess the records, but that the records are closed by law, we will provide you with that information together with a written citation to the laws allowing or requiring that type of public record to be closed.
