Pursuant to RCW Ch. 42.56 (Public Records Act), I hereby request the following records:
Incident Action Plan for demonstrations and other events surrounding the upcoming announcement of a decision in the grand jury investigation of the August, 2014, homicide of Michael Brown by Darren Wilson of the Ferguson, Missouri Police Department. Please include all draft and final versions along with any associated metadata.
I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Almost three months have passed since I filed a simple request for a single, clearly-identified incident action plan. You have provided three different estimates of time required to complete processing, on November 25, December 18, and January 28, estimating total time to completion of approximately 4 weeks, then 10 weeks, then 16 weeks. You have not provided any explanation for the delay or for the dramatic adjustments of the time you require to complete the request. Time to locate the record should be negligible; I clearly identified it, and it concerns a high-profile that came in response to an event of national awareness. I would expect that any redactions to the report could be made in less than one hour.
Who is assigned to work this request? Approximately how much time is spent working on this request each week?

Enclosed please find a copy of the records you have requested.
Redactions have been applied throughout the records pursuant to RCW 42.56.420 and/or other statutes.
· Terrorism: The record contains information assembled, prepared, or maintained to prevent, mitigate, or respond to criminal terrorist acts. RCW 42.56.420(1). Explanation: Disclosure of the information would expose specific vulnerabilities, response plans, and/or endanger citizens/law enforcement personnel.
· Computer/Telecom Passwords/Security/Internal-Use Only Phone Numbers: Information regarding the infrastructure and security of computer and telecommunications networks, consisting of security passwords, security access codes and programs, access codes for secure software applications, security and service recovery plans, security risk assessments, and security test results are exempt from disclosure pursuant to RCW 42.56.420(4). Explanation: Unauthorized access to the information could disrupt police operations, negatively affect police investigations, endanger citizens/law enforcement personnel, result in theft, fraud or other criminal activity, and expose law enforcement personnel to harassment.
We have not prepared a detailed exemption log for records because only limited information has been redacted from the responsive records. The information normally provided in an exemption log, such as title, author, recipient, subject, and number of pages, is readily ascertainable by looking at the redacted records.
You may file a written appeal of this response with the Chief of Police within ten (10) business days from the date of this letter. Please include your name and address and a copy of this letter together with a brief statement identifying the basis of the appeal. Please mail or deliver your appeal to:
