A copy of all files on the Hackers On Planet Earth (HOPE) hacking conference, which has taken place in New York City at the Hotel Pennsylvania since 1994, with the following dates and keywords:

July 16-18, 2010, any records relating to Julian Assange, Jacob Appelbaum, Adrian Lamo, or Wikileaks
July 13-15, 2012, any records relating to William Binney or the National Security Agency (NSA)
July 18-20, 2014, any records relating to Edward Snowden, Daniel Ellsberg, or the National Security Agency (NSA)
July 20-22, 2018, any records relating to Chelsea Manning

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

To whom it may concern:

This is an appeal of an improper denial of a records request submitted to the New York Police Department under the New York Freedom of Information Law.

On November 22, 2020, the FOIL request attached to this appeal was submitted to the NYPD. This request was related to materials on specific individuals on specific dates. On November 25, 2020, the agency responded with the following rejection message: "The Freedom of Information Law allows access to existing documents and does not necessitate the creation of a document. I am unable to provide access to these documents on the basis that your request does not reasonably describe a record in a manner that would enable a search to be conducted by the New York City Police Department."

This is an appeal of the integrity of the search conducted by the NYPD. I would also like to contest the agency's failure to fulfill its obligations under NYCRR Section 1401.5(c)(1), which states that, within five days, an agency shall provide "direction, to the extent possible, that would enable that person to request records reasonably described." I received no such direction, only a note that the records officer did not deem my request one that would lend itself to a search by the NYPD.

I respectfully request that your office remand this request to that department for proper processing under the spirit and the word of the New York Freedom of Information Law.
