Pursuant to Florida's Sunshine Law (Fla. Stat. secs. 119.01 to 119.15 (1995)), I hereby request the following records:

All evaluations, inspections, reports, and related materials regarding all services, equipment, and activities involving/provided by/contracted for regarding Graceville Correctional Facility and any facilities associated with it, either before, during, or after the contract term for which the facility was under obligation to the Florida Department of Corrections.

Responsive materials should include but not be limited to:

• all annual inspections
• all emergency event reports and evaluations
• all records of inspections conducted in accordance with DOC provisions, such as those of the American Correctional Association
• all reports regarding the transfer of prisoners
• all reports regarding the performance of the contract and associated duties

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Ms. Lipton:

The Department of Corrections is in receipt of your public records request below for all evaluations, inspections, reports, and related materials regarding all services, equipment, and activities involving/provided by/contracted for regarding Graceville Correctional Facility and any facilities associated with it, either before, during, or after the contract term for which the facility was under obligation to the Florida Department of Corrections.

Responsive materials should include but not be limited to:
• all annual inspections
• all emergency event reports and evaluations
• all records of inspections conducted in accordance with DOC provisions, such as those of the American Correctional Association
• all reports regarding the transfer of prisoners
• all reports regarding the performance of the contract and associated duties

Please clarify the date range requested as “…either before, during, or after the contract term for which the facility was under obligation to the Florida Department of Corrections.” This facility has always been under contract by the Department of Management Services.

The Department of Corrections has no records of “all reports regarding the performance of the contract and associated duties”. Further, there are no existing records of “transfers of prisoners” maintained by the Department of Corrections in the manner you have requested.

With regard to the remaining requested items:

• all annual inspections
• all emergency event reports and evaluations
• all records of inspections conducted in accordance with DOC provisions, such as those of the American Correctional Association,

upon receipt of the clarified date range for production of records, your request will be forwarded as appropriate for review and response.

Thank you for your request for clarification. I would be interested in receiving all materials regarding the transfer of Graceville from CCA to GEO custody and any that have been produced since then. I believe this date range is approximately 2004 through the present.

It appears you are requesting records of procurement and operation of private facilities, specifically Graceville CF, for which the Department of Corrections has no responsive records. You would need to submit such a request to the Department of Management Services.
