Due to the current state of civil emergency, Seattle IT will need additional time to process your PDR request. technology--automated face recognition--by way of their use of a
mailing list system that your agency maintains. As I wrote
previously, reporter Michael Hayes wrote in his November 11, 2019,
[article][2], "Washington Cops Are Taking a Cue From ‘Fight Club’
for a Secret Facial Recognition Group," that "[o]fficers on the
listserv are encouraged to adopt a Fight Club-style directive that
precludes group members from discussing the existence of the list

The following day, on November 13, 2019, I placed [a request][3]
with your agency for that document as well as similar records. I

I knew from previous interaction with Seattle Department of
Information Technology staff that your agency maintains the city's
LISTSERV mailing list management system. I have previously
requested and received records from your agency's LISTSERV system
via Public Records Act request to your agency (such as my October
14, 2015 [request][4] for "Index of mailing lists hosted on
talk2.seattle.gov"). So, I was then and to this day remain
confident that your staff have access to the records I seek.

You have not provided those records. Nor have you informed me
that they do not exist or informed me that they are exempt from
release under the PRA. In fact, you informed me that responsive
records may exist, you opined that those records would likely be
stored in your department's mailing list management system, and
you claimed that in order for me to verify that they exist and
receive them, I would need to file a new request for them. This
is a clear violation of the law.

This delay is inexcusable. It has been 15 months since I placed
my request (which, I note, your agency received several months
prior to emergence of the COVID-19 pandemic). This is not a
complicated request. These records are almost certainly all
digital--we're not talking about searching filing cabinets or
basement archives for paper records. Further, the records are
stored in a system, LISTSERV, used for many years by your agency,
that provides an interface for searching records in the system
that is designed to be simple enough even for end users--not just
system administrators--to search for and retrieve records. A
search in this case involves some typing, a few mouse clicks, and
maybe a phone call. I estimate that it would take someone about
30 minutes to search for, retrieve, attach to an e-mail, and send
to me the records.

I have gone so far, in a good-faith effort to assist, as to
suggest research methods that are likely to help your staff find
responsive records: On January 13, 2021, in my appeal of your
agency's decision, I suggested, "that you inquire with the list
maintainer(s) and/or moderator(s), and that you perform an
automated search of list archives for the string, `Do not mention
FITlist.'" Despite this, I am aware of no indication that your
agency inquired with maintainers and/or moderators of the FITlist
mailing list, or that you searched list archives for the string I
quoted in my initial request and repeated in my appeal.

These records are related to a matter of great public interest, as
evidenced by the aforementioned reporting on the topic and by the
comments from ACLU of Washington reported in said report: "Shankar
Narayan, Director of the Technology and Liberty Project for ACLU
of Washington, says that the use of a listserv to make backroom
requests `with no opportunity for the public to know and to
understand' what information is being shared is concerning.
Narayan adds that secret partnerships like these could also be
used to circumvent jurisdictions that have banned facial
recognition technology."

Your delay in providing these records--and your recent outright
refusal to provide them--appears intended to keep the public in
the dark about actions of our public staff. Worse, I believe that
the records you refuse to provide would reveal efforts of public
staff to hide their on-the-job and work-related communications
from the public and from the courts. You and your colleagues are
seemingly attempting to hide public records about public staff
intentionally hiding public records from the public and from the
courts. Your actions surrounding this matter violate the letter
and spirit of the law, and they appear to have been made in bad
faith.

I note that your job title appears to be "Citywide Public
Disclosure Program Manager," so I trust that even if the reported
designation (by you, as stated in your February 10 communication
to me) of records held by one City of Seattle department,
Information Technology, as owned by another City of Seattle
department, Police, was to complicate access by your staff to
those records, you of all people are familiar with remediation of
such self-imposed impediments to work the law requires your agency
to perform.

Please promptly provide all responsive records to which your
agency has access. If or how your staff have, as you stated to
me, designated "ownership" of "the substantive content" of records
under your control is not relevant to your duties under the Public
Records Act. There is no exemption in the PRA for records an
agency holds and that the agency has designated as "owned" by
another agency.
