This is a request under the Freedom of Information Act. I hereby request the following records:

All reports of incidents that result in injury or death submitted by the FBI to the Department of Justice, Civil Rights Division from January 1, 2010 to December 31, 2013.

Per a 2004 DOJ IG report (available here: http://www.justice.gov/oig/reports/plus/e0410/final.pdf):

In 2000, the CRD established written agreements with the DEA and the FBI that require them to report incidents that result in injury or death.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This is an appeal of the determination that my request 1265872-000 is "unduly burdensome" and does not provide enough detail to allow FBI FOIA staff to locate documents.

Not only did I describe the circumstances that led to the creation of the requested documents — that is, incidents that result in injury or death — but also the entity to which the FBI reports such incidents, namely the Department of Justice, Civil Rights Division. I also included a time frame for search — January 1, 2010 to December 31, 2013.

The attached MOU concluded between the FBI and DOJ CRD in 2000 may provide additional guidance for the search for responsive documents for the present request. However, as originally submitted, my request included more than enough information to allow FBI FOIA staff to process the request. Furthermore, FBI FOIA staff could easily have requested additional details from me rather than shut down the request in its entirety.

In light of the above, I request that you remand this request back to FBI FOIA for good faith search and provision of responsive documents.
