This is a request under the Freedom of Information Act. I hereby request the following records:
All policy and guidance documents regarding the preservation of text messages.
A 2011 Attorney General memo (see http://www.justice.gov/sites/default/files/oip/legacy/2014/07/23/electronic-communications.pdf) directed that, "Each component should provide guidance to affected employees on how to preserve the various messaging formats (text, SMS, 1M, PIN, etc.), or any other e-communication that may contain potentially discoverable information. Where an e-communication containing potentially discoverable information cannot be preserved electronically or printed, the agency's inability to do so should be documented so that the preservation approach can be explained in court."
Given that this FOIA is submitted in my capacity as a journalist who has covered federal law enforcement extensively, I request that I be categorized as a media requester for the purpose of fees. Here is a selection of my published articles on MuckRock:

I received the FBI's letter dated October 11, 2016 indicating that a search of the CRS failed to locate responsive records for this request. The letter asked for any "additional information pertaining to the subject that you believe was of investigative interest to the Bureau."
This request is not for investigative materials, but for policy documents. Again, I seek: "All policy and guidance documents regarding the preservation of text messages," in keeping with the cited Attorney General memo.
I do not believe that the CRS is the appropriate records system to search for responsive documents. Rather, the FBI must search recordkeeping systems that are reasonable places to find responsive records. Accordingly, please conduct a good faith search and provide responsive documents pursuant to your obligations under FOIA.

I hereby appeal the inadequate search by the FBI in response to my FOIA request, which the agency assigned tracking number 1329397-001.
In my request to the FBI dated 05/19/2015, I requested: "All policy and guidance documents regarding the preservation of text messages."
I provided the following additional information: A 2011 Attorney General memo (see http://www.justice.gov/sites/default/files/oip/legacy/2014/07/23/electronic-communications.pdf) directed that, "Each component should provide guidance to affected employees on how to preserve the various messaging formats (text, SMS, 1M, PIN, etc.), or any other e-communication that may contain potentially discoverable information. Where an e-communication containing potentially discoverable information cannot be preserved electronically or printed, the agency's inability to do so should be documented so that the preservation approach can be explained in court."
In response to my request, in a letter dated November 23, 2016, the FBI responded that it was unable to locate documents responsive to my FOIA.
I appeal on grounds of inadequate search in light of the Attorney General memo above, which indicates that agencies were to provide guidance for employees as to the preservation of "various messaging formats." It has been several years since this AG memo was promulgated and sent to Justice Department agencies. Such memos are typically instantiated for given agencies within the Justice Department via agency-specific policies. Similarly, "guidance" for agency employees typically comes in the form of memos such as the ones I seek. Finally, I additionally sought all "guidance documents" through which employees were guided on this topic as required by the AG memo. Barring the possibility that the FBI ignored a memorialized command from the head of its parent entity, as well as the unlikely scenario in which all guidance on preservation of texts was conducted by spoken word, there must be documents that guide FBI employees as to preservation of texts and other electronic communications in keeping with discovery obligations.
As such, I appeal the FBI's inadequate search, and ask that you remand this request for good faith search and provision of responsive records under the Freedom of Information Act.
