Pursuant to the Nebraska Public Records Act, I hereby request the following records:

All documents pertaining to the state’s emergency plans for a heat wave or for extreme heat.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Documents Requested: All documents pertaining to the State of Nebraska emergency plans for a heat wave, or for extreme heat.

Response:

The Nebraska Emergency Management Agency does not maintain any plans specifically addressing a heat wave or extreme heat. Similarly, the agency does not have specific plans addressing other weather-related conditions such as tornados, flooding, blizzards, or other conditions brought about by weather extremes. The agency responds to natural disasters and other emergencies based on the "all-hazards" approach for emergency management. Requests for assistance and the allocation of resources required to meet such requests will be done in accordance with the Nebraska Emergency Management Act and the State Emergency Operations Plan.

I have attached a digital copy of the Nebraska Emergency Management Act which includes State Statutes 81-829.36 to 81-829.75.

The State Emergency Operations Plan is considered a document exempt from public disclosure based on the interpretation of Nebraska Statute 84-712.05 (8); which states: "Information solely pertaining to protection of the security of public property and persons on or within public property, such as specific, unique vulnerability assessments or specific, unique response plans, either of which is intended to prevent or mitigate criminal acts the public disclosure of which would create a substantial likelihood of endangering public safety or property; computer or communications network schema, passwords, and user identification names; guard schedules; lock combinations; or public utility infrastructure specifications or design drawings the public disclosure of which would create a substantial likelihood of endangering public safety or property, unless otherwise provided by state or federal law."
