Pursuant to the Massachusetts Public Records Law, M.G.L. c.66, ยง10, I hereby request the following records:

1) A copy of the Enterprise Investment Verification (EIV) system's state-level "Debts Owed to PHA's & Terminations Report" for Massachusetts. A description of how to access this report is available in Section 4.1.3.4.2 of the EIV user manual (https://portal.hud.gov/hudportal/documents/huddoc?id=eivsystemmanual.pdf). As the manual describes, the state level "Debts Owed to PHA's & Terminations Report" should include breakdowns of statistics for each public housing authority (PHA) within the state.

2) Copies of the EIV system's PHA-level "Debts Owed to PHA's & Terminations Report" for the Lowell, Dracut, Tyngsboro, Tewksbury, Billerica, Chelmsford, Westford, and Wilmington housing authorities. A description of how to access this report is available in Section 4.1.3.4.5 of the EIV user manual (https://portal.hud.gov/hudportal/documents/huddoc?id=eivsystemmanual.pdf). In the event that the report contains identifying information about an individual, such as a partial social security number or name, I acknowledge that said information must be redacted. It should be noted that statutory and and case public record law in Massachusetts dictates that the presence of exempt information in a public record does not necessitate the withholding of the entire record. Agencies are required to redact exempt information and provide the rest of the releasable record.

I also ask that all fees be waived as I am a journalist employed by the Lowell Sun and I intend to use the requested records to publish articles in the public interest and not for any commercial purposes. I would be happy to discuss my request at any time, and can be reached at 978-970-4650.

This is in response to your requests to the Executive Office of Housing and Economic Development (EOHED) for records related to certain public housing authorities. EOHED has determined that it does not maintain records that would be responsive to your request, nor do we have access to the systems on which you indicated that such records exist. However, we have forwarded your request to the Department of Housing and Community Development (DHCD), which has regulatory authority over public housing authorities. DHCD will respond to you directly.

In the future, it would be both more efficient if you could direct requests for public records from EOHED to this address. Although it is not a requirement to do so, we have had issues in the past with requests submitted by fax and have found that it is more reliable to address requests through the dedicated portal.
