To Whom It May Concern:

Pursuant to the Freedom of Information Act, I hereby request the following records:

All DEA records mentioning or pertaining to the late John David McAfee. An attached news story shall serve as proof McAfee has passed away in 2021; as such, privacy interests recognized under exemptions to FOIA as well as the Privacy Act are diminished, and investigations concerning McAfee as a subject are minimally impacted.

To assist in the identification of records, please note the following identifiers:

First five digits of Social Security Number 223-60;
DOB: September 18, 1945;
POB: United Kingdom

"DEA Records" include records within the following systems of records (not exclusively): Automated Intelligence Records System (Pathfinder); Investigative Reporting and Filing System (IRFS); Grants of Confidentiality Files (GCF); Operations Files; El Paso Intelligence Center (EPIC) Seizure System (ESS); and Security Files.

In addition, please return a result for a query of Narcotics and Dangerous Drugs Information System (NADDIS) pointer index to IRFS, using the aforementioned subject's name and (where necessary) accompanying identifying numbers and/or date of birth.

If any potentially responsive records have been destroyed and/or transferred to NARA, then I request copies of the destruction or transfer slips as well as any other documentation relating to, mentioning or describing said transfer or destruction, to include but not be limited to confirmation that the DEA has no other copies of said records.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

Sincerely,

T. McElwee

Good morning Mr. McElwee:

I hope all is well. This email responds to your Freedom of Information Act/Privacy Act (FOIA/PA) request dated August 23, 2021, addressed to the Drug Enforcement Administration (DEA), Freedom of Information/Privacy Act Unit, seeking access to information regarding the above subject.

To process this request, we require proof of death. To the extent that non-public responsive records exist, without consent, proof of death, or an overriding public interest, disclosure of law enforcement records concerning an individual could reasonably be expected to constitute an unwarranted invasion of personal privacy. See 5 U.S.C. § 552(b)(7)(C). Because any non-public records responsive to your request would be categorically exempt from disclosure, this Office is not required to conduct a search for the requested records.

Acceptable forms of proof of death include obituaries, death certificates, recognized sources that can be documented, date of birth is 100 years or greater, or Social Security Index Page.

If this office does not receive your response within 30 days, DEA will assume that you do not wish to pursue this matter and your request will be administratively closed. Please e-mail your response to dea.foia@usdoj.gov<mailto:dea.foia@usdoj.gov>.

Respectfully,

Kind Regards,

Ms. Eyob,

Attached, please find both the PDF I provided in the original request (from Reuters) and an additional PDF of a story from the NY Times, both dated June 23, 2021.

These news stories, documenting that McAfee died by suicide, should be sufficient to prove that he is dead and that privacy concerns are diminished.
