A list of all open investigations (as of the date this request was received) into higher education institutions for violating Title IX protections in their handling of sexual assault cases. Please include college/university name, status of investigation, date investigation was opened, and reason why the investigation was opened.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This is to acknowledge receipt of your FOIA request of July 25, 2017, which was received in the Washington, D.C. office of the U.S Department of Education (Department) on the same day. You requested "a list of all open investigations (as of the date this request was received) into higher education institutions for violating Title IX protections in their handling of sexual assault cases. Please include college/university name, status of investigation, date investigation was opened, and reason why the investigation was opened" (copy attached). Your request is being processed under the Freedom of Information Act (5 U.S.C. § 552).

We need to speak with you to clarify your request. We will not be able to proceed without clarifying your request. Please call to discuss at your earliest availability. Your request is on hold pending clarification.

Please be aware that release of documents may be more restricted when matters are open for evaluation, investigation, resolution, appeal or monitoring (see 5 U.S.C. § 552 (b)(7)(A)). Also, note that because of exemptions to disclosure under FOIA, all documents responsive to your request will be redacted to remove the names of all individuals and other personally identifiable information. See (b)(6) and (b)(7)(C) of 5 U.S.C. § 552. Generally, our office has 20 working days from receipt of the request in our office to respond in some manner to FOIA requests. We will make an effort to respond to your request quickly. For your information, under FOIA, OCR provides the first 100 pages of hard copies free of charge with the remaining pages provided at a copying cost of 20 cents per page. Electronic documents, if voluminous, are provided by compact disc at a charge of $3.00 per disc. The Department's implementing regulations provide the first two hours of search time without charge. Should we require more time, we will notify you if the estimated costs exceed $25 before we continue to process your request. Generally, our office provides documents in electronic format unless otherwise specified by the requestor.

I was recently told I had to revise this request, because I could not receive information on open investigations. I instead requested closed sexual assault investigations, and received that data. received information on open sexual violence investigations at the post-secondary level.
