Recognize that FOIA case law establishes the extent to which agencies MUST search all records system reasonably believed to contain responsive documents, even if it means contacting former employees. Truitt v. Department of State, 897 F.2d 540, 542 (D.C. Dear Mr. Peck:

The records you have requested are not located in one easily searchable database. There is no "report" that the Division can run from a central computer system that will provide the information on each entity for each and every Civil Rights Division employee that worked for the Division for the unspecified number of years that your request seeks. The number of hours necessary to fulfill a thorough review of even a one year volume of the Division's records of over 800 employees will require a significant expenditure of the Division's resources.

In addition to the current number of Division staff, there have been numerous employees that have left by attrition during the relevant time period. Aside from numerous other types of files, in order to search for solely the email for the employees that no longer work for the Department, the Division would have to retrieve and convert the records systems to a workable format. It takes one full day to convert the records for six employees. Calculating a search for each group of six employees, the transformation into a searchable format will require two months for 1-2 individuals working full-time on your project. As a conservative projection, the time necessary to fulfill a thorough search of all Division personnel will require at least 300 to 500 hours of time to construct a database prior to being able to conduct a search. The result of that search as well as a broader search for responsive records among all other Division employees could be that the search may not locate any responsive records yet the Division will have to accrue the expenses necessary to conduct the search as you have formulated it. Since your project would have to be worked into hundreds of other projects on which the technicians are assigned, the time needed to conduct a search that is this extensive, the search will take a substantial number of weeks to complete.

As you are also likely aware, the Freedom of Information Act [5 U.S.C. § 552(a)(4)] provides for the assessment of fees. In accordance with 28 C.F.R. § 16.11, the Civil Rights Division may assess fees for duplication and searches.

The searches necessary for the records responsive to your request will require the assistance of the Division's managerial personnel. Search fees may be assessed at the cost of $10.00 per quarter hour for search time that must be completed by professional level information technology personnel. The first two hours search time is free in accordance with Department regulations and has been expended already with respect to your request.

The estimated time to construct a database to locate one year of potential emails or letters for the requested subject matter:

Profession staff: 300 hours

Managerial search: $40.00 per hour X 298 hours (300 hours - 2 free hours)
= $ 11, 920.00

Please note that this is an estimate only and the actual cost may total substantially more in the final calculation.

Act (FOIA) request dated and received in the Office of the Pardon
Attorney (OPA) on March 18, 2016. I apologize for the delay in
responding to you but our office is dealing with a backlog of FOIA
requests. Pursuant to the Freedom of Information Act (FOIA), 5 U.S.C.
