Pursuant to the Colorado Open Records Act, I hereby request the following records:

All contracts (and their amendments) and memorandums of understanding entered into by the Crowley County (CO) for services and activities related to the Crowley County Correctional Facility (https://www.cca.com/facilities/crowley-county-correctional-facility)

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Crowley County has received a request for information regarding Crowley County Correctional Facility. We will be happy to comply. I am not sure we have the capacity to scan and email everything but we will try. The documents amount to 81 pages plus approximately 100 pages of appendices. Total cost to you will be approximately $71.25, using $0.25 per page and $25.00 for an hour of my time. I will attempt to to send just the two contracts which will amount to 81 pages. At $0.25 per page and $25.00 for an hour of my time, the total cost would be approximately $45.00

Please advise if you agree to any of the above and I will begin working on the project this afternoon.

I would be happy to mail you a cd and a self-addressed envelope, if that might alleviate some of the costs associated with paper. Of course, there's no substitute for your time, but if there may be electronic methods by which the contracts could be obtained, that would be ideal.

This is in regard to your latest fax. If I can scan the contracts and send them in four or five different groups, I think I can email all to you and if I limit the package to 81 pages, I can do it for the amount noted, approximately $45.00. If I have to copy everything and mail the package to you, it will cost a lot more, as I will be doing it and I don’t think I can’t do it in an hour. These documents are in hard copy. As such, I will have to scan everything and then transfer all to a cd. This is the same as if I sent them by email. Let me know what you want to do and I will try to get it done. We are a very small county and I will be on vacation beginning tomorrow and returning on the 29th. There is no one else available to take on this task. Again, let me know, and I will try to get it done on the 29th and 30th. If possible, contact me by email. For some reason, your faxes are extremely hard to read.

As per your last email dated 12-31-14, you advised that you would be in touch again in the new year.

I can begin working on the data, if you would simply tell me what it is you want. I can tell you, Crowley County has a contract with CCA and all of the previous private prison contractors, that clarifies that the private prison contractor assumes all liability for any wording in the contracts with the State of Colorado that mentions Crowley County being responsible for literally anything. If this is what you are looking for, I can save you a lot of time and money. As noted before, I can send you hundreds of pages or I can send a few. I told you earlier what it would cost.

I apologize for the delay in my response. If I amend my request to the following, will there be a difference in associated costs?

All contracts (and their amendments), memorandums of understanding, intergovernmental service agreements, and any other agreements entered into by Crowley County, Colorado for all services, equipment, and activities involving/provided by/contracted for regarding Crowley County Correctional Facilities. For all agreements with private operators, please include the following materials:

• the initial Invitation to Bid, Request for Proposal, or equivalent call for contractors
• the responsive materials provided by the winning bidder
• all other vendor responses
• all evaluation material, scorecards, reports, and notes generated in the selection process
• the current contract
• all exhibits
• all amendments
• all agreements for the provision of services, such as water and sewage
• all financial and bond agreements entered into as part of any of the aforementioned agreements

I have a contract with the State of Colorado and a contract with CCA holding Crowley County harmless for any and all business executed by CCA at the Crowley County Correctional Facility. I do not have any other records requested in your email. The total is approximately 100 pages. Send me a check for $25.00 and we’ll call it good. Email me a copy of a check payable to Crowley County for $25.00 for my services. Upon receipt, I will scan and email the documents. Then stick the check in the mail to Crowley County Administration, Attn: Tobe Allumbaugh, 603 Main, Suite 2, Ordway, CO 81063.
