Pursuant to the Washington Public Records Act [RCW 42.56] I hereby request the following records:

I request a complete electronic copy of all Public Records Requests received by Central Valley School District and a complete electronic copy of the District's Responses to these Public Records Requests for the time period January 1, 2010 through November 4, 2021.

In the event the District chooses to provide these records in installments over time I request the records to be produced in reverse chronological order - from the most recent records to the earliest.

If this request is denied in whole or part, I ask that you justify all deletions by reference to specific exemptions of the PRA. I also request a detailed contemporaneous log to be provided for any document withheld or redacted.

For each responsive record the District contends is exempt from public disclosure, in whole or in part, please specifically identify the record by subject, title, author, custodian and date, and state how a specific statutory exemption applies to each record as required by RCW 42.56.210(3) and Rental Housing Ass'n v. Des Moines, 165 Wn.2d 525, 199 P.3d 393 (2009).

I request electronic production of all electronic records in the original NATIVE electronic format for each record.

I request for these public records to be produced by public (no password) e-mail attachment or link. If electronic attachment or link is not possible, an alternative would be to produce responsive records via USB DRIVE or DATA CD-ROM.

THIS REQUEST IS NOT BEING MADE FOR COMMERCIAL PURPOSES.

The requested documents will be made available to the general public.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request.

Please consider this in response to your November 5, 2021 public records request for a "copy of all Public Records Requests received by Central Valley School District and a complete electronic copy of the District's Responses to these Public Records Requests for the time period January 1, 2010 through November 4, 2021."

As you are likely aware, public records laws recognize that additional time to respond to a request is allowed when needed for the following reasons: (1) to determine if there is a need to clarify the intent of the request; (2) to determine if any information requested is exempt; (3) to locate and assemble the information requested; or (4) to notify third persons or agencies affected by the request. This is the case here as the District will need time to locate and assemble any responsive records.

Please understand, however, that the ongoing impacts of COVID-19 in Washington state and the District's other educational obligations during the continuing COVID-19 State of Emergency, as well as the District's obligations during the school year, are impacting the District's ability to process public records requests as significant time and resources are being dedicated to other administrative functions of the District. Additionally, given the upcoming Thanksgiving Holiday and District Winter Break, at this time the District anticipates being able to respond more fully to your request by January 7, 2022. That said, we will certainly provide any responsive records to you sooner if we are able to do so.

Additionally, although the District anticipates responding to your request in installments and does not know at this time what the total charges will be, the District may require a deposit of up to ten percent of the estimated costs of copying all the records requested and utilizes the following statutory default charges for electronic records:

* 10 cents/page for records scanned into electronic format;
* 5 cents for every four electronic files or attachments uploaded to an email, cloud storage service, or other electronic delivery system;
* 10 cents/gigabyte for transmitting records electronically.

In reviewing records responsive to your request, the District has identified records provided to an original requester in response to requests for lists of individuals. Please note that Washington's Public Records Act restricts agencies from providing lists of individuals for a commercial purpose. In particular, the Public Records Act authorizes agencies to require a requester to provide information as to the purpose of a request "to establish whether inspection and copying would violate RCW 42.56.070(8)...." In order to comply with the obligations of RCW 42.56.070(8), in responding to a public records request that includes a list of individuals an agency must investigate if that list might be used for commercial purposes. "Commercial purpose" has its ordinary meaning and includes a business activity by any form of business enterprise intended to generate profits, revenue or financial benefit.
