Pursuant to the California's Sunshine Amendment (Cal. Const. Art. I, § 3(b)), I hereby request the following records:

All contracts and their amendments between the California Department of Corrections and Rehabilitation and Corrections Corporation of America (CCA) for La Palma Correctional Center (http://www.cdcr.ca.gov/Visitors/CA_Out_Of_State_Facilities.html)

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Our department does not have contracts with the facilities (Boston Avenue, Ocean View, and San Diego) that you listed in the three other Public Records Act requests that you submitted on Saturday. We also cannot find any documentation to show that we had contracts with those facilities in the past. As a result, we will not be processing those three requests.

I apologize for the delay in my response to this request. I would still like to obtain the responsive materials. However, I would also like to expand my request to include all of the following elements:

• the initial Invitation to Bid, Request for Proposal, or equivalent call for contractors
• the responsive materials provided by the winning bidder
• all other vendor responses
• all evaluation material, scorecards, reports, and notes generated in the selection process
• the current contract
• all exhibits
• all amendments

Should I submit a new request?

You should be aware that costs are incurred when we process PRAs even if the requestor does not end up paying for the work to be done. While you do, of course, retain the right to submit Public Records Act requests, I hope you will please also respect the value of public resources by following through on your requests after we have spent weeks or months evaluating them and preparing to respond to them.

Thank you very much for your message. I appreciate the time your staff has spent conducting the searches and reviews I have requested, and I hope that you do not interpret my delayed responses as indications that the materials are not desired. The necessity of fees is ever a burdensome obstacle.

Should I, then, proceed to submit new requests in order to obtain the additional materials in which I am interested? I understand work has already been completed on the previously requested materials.

I will defer to Kathryn Clark, the attorney working on this case. If she says it should be a new request, that’s fine with me; and if she says it isn’t, that’s also fine with me.

I’m sorry that you find costs a burdensome obstacle. But some PRAs are very expensive to process, and California law allows us to charge appropriately so that requestors are bearing at least some of the cost that California taxpayers must otherwise shoulder.
