Exemptions and Privileges

The SFMTA is not required to disclose records where disclosure of such records would constitute an unwarranted invasion of personal privacy. (California Constitution, Article I, §1; Cal. Gov't Code § 6254(c); see also Cal. Gov't §6254(k); Hill v. National Collegiate Athletic Assn., (1994) 7 Cal. 4th 1, 35 (identifying privacy interest in precluding dissemination of sensitive, confidential information); Teamsters Local 856 v. Priceless, LLC, (2003) 112 Cal. App. 4th 1500, 1512 (public employees have right of privacy in their personnel files); Braun v. City of Taft, (1984) 154 Cal.App.3d 332, 345-347); City of San Jose v. Superior Court, (1999) 74 Cal.App.4th 1008 (court denied media's request for names and contact information of complainants).) Because disclosure of some of the documents responsive to your request, are personnel records, containing information confidential under both the California Constitution and Section 6254(c) of the Public Records Act, we have redacted portions of some of the documents that we are disclosing for this reason.

RE: SOTF FILE 19133 - for addition to the file

To MTA: Thank you Ms. Celaya. As is our standard practice, we are happy to, in exchange for a specific letter signed by your department head discussing how MTA will improve its records procedures, dismiss this case. If you would like to discuss the details of such a negotiated dismissal, please let me know. Otherwise, we shall continue to seek all violations and orders in this case. (We reserve our right to file further complaints or appeals about the content as opposed to timeliness of your response as well.)

To SOTF: Given the Respondents' amended response, the SOTF should take as proven the sole alleged 67.21/67.25 violation in Case 19133 - Respondents failed to respond in a timely or complete manner to an immediate disclosure request. The Dec. 7 Saturday IDR was deemed received Monday Dec. 9. Initial response was due Dec 10. First actual response was actually Dec. 24.

Note that Celaya indicates this is timely with respect to *her* receipt, not Maguire's receipt, of my request. However, Respondent Maguire is and was independently required by law to respond to emailed requests (SFAC 67.21(c)) as held repeatedly by SOTF pursuant to *his* receipt of the request. We take no position on whether Maguire must personally respond or his delegate Celaya may respond on his behalf (which appears to be a long-pending issue before SOTF), but the clock runs as to the receipt by anyone in MTA of a records request.

As a general aside, this case is yet another example why electronic metadata is so important in public records. I could prove who knew what when using email metadata.

Below are new Immediate Disclosure Requests (SF Admin Code 67.25(a)) directed to your agency and the department head. Your response is required by Feb 11, 2020. Rolling records responses are requested (SFAC 67.25(d)) if you are unable to immediately produce records. Exact copies of every responsive record are requested (Gov Code 6253(b)) - do not: provide mere URLs, print and scan electronic records, convert native files to PDFs, or provide black and white versions of any color record. Provide only copies of records not requiring fees and in-person inspection of all other records (GC 6253). Emails are requested in the easily-generated EML or MSG formats (SFAC 67.21(l)).

I am now auditing how the City appears to unlawfully withhold the BCC recipients of emails when they print out emails in certain formats. The identity of BCC recipients is not exempt. BCC is not an information security record that reveals vulnerabilities or increases chance of an attack. The BCC names was typed in by a human being and are not metadata. You must provide BCC just like you provide To or CC recipients. There is no legal authority to keep secret the identities of persons communicating with government officials, unless they are specifically confidential informants and such. If you withhold the BCC names, I will file complaints, separate and apart from email metadata complaints (which I have now already won, see ruling in SOTF 19044).

Your non-exhaustive obligations: All withholding of any information must be justified in writing (SFAC 67.27). All withholdings by masking or deletion (aka redactions) must be keyed by footnote or other clear reference to the specific justification for that redaction, and only the minimal exempt portion of any record may be withheld (SFAC 67.26). You must respond to emailed requests (SFAC 67.21(b)). You must notify us of whether or not responsive records exist and/or were withheld for each below request (Gov Code 6253(c), 6255(b)). You must state the name and title of each person responsible for withholding any information (Gov Code 6253(d)). Do not impose any end-user restrictions upon me (Santa Clara Co. vs Superior Ct, 170 Cal.App 4th 1301); so if you use a third-party website to publish records, please make them completely public without any login or sign-in.
