I am confirming that we received your emailed Immediate Disclosure Request today for records related to Mohammed Nuru's calendar (see attached).

As you know, our department uses the NextRequest online records request system and you will receive an email from Nextrequest.com with instructions for following up on this request. In the future, please make requests for Public Works records online at: http://sfpublicworks.org/records.

Our department will identify and compile the requested information. The Sunshine Ordinance requires departments to respond to an Immediate Disclosure Request no later than the close of business the next business day. Therefore, we will contact you as soon as the responsive documents are ready for you to view and will do so on or before Dec. 17, as permitted by San Francisco Administrative Code § 67.25(a).

Please note that the Public Records Act requires an agency to make available to any person a copy of an "identifiable record or records" in its possession, unless the record is specifically exempt from disclosure. (Please see California Government Code § 6253(b).) The City's obligation under the Sunshine Ordinance, like the Public Records Act, is to produce public records in its custody. (See San Francisco Administration Code § 67.20(b).) There is no requirement that a department or officer construct a document to meet the specifications of the request.

We will produce responsive records online through the NextRequest portal. However, if hard copies are needed, we can provide hard copies of any 8.5x11 documents that are made available to you at a cost of 10 cents per copy, as allowed by the San Francisco Administrative Code § 67.28(c). This section states "a fee not to exceed 10 cents per page may be charged." Postage is an additional cost.

In lieu of hard copies, we can burn the responsive records onto a CD at a rate of $1 per CD or load the responsive records onto a flash drive at a rate of $4 per flash drive. Fees for duplication are subject to change and postage is an additional cost.

Frankly I don't understand what that citation has to do with anything. If I ask for a copy of some records I get a copy.
The request you pointed me to (https://sanfrancisco.nextrequest.com/requests/20-428) has over one thousand records. Which ones are responsive to my request? I do not believe the requestor is supposed to search the records instead of the City, even under CPRA.

I will also be enforcing 67.26. You have followed those rules in the past and I'm not sure why, when things become critical, these rules would be thrown out the door.

Although Prop. G requires that department head calendars be maintained for two years, a period of time that is listed in our records retention policy, it has not been the practice to delete older copies.

For this reason, the Prop. G calendar for Mohammed Nuru extends back to his appointment as director in 2011. For this reason, there are potentially thousands of responsive records, all of which would need to be reviewed and potentially redacted to protect private information of individuals contacting the department. To facilitate a prompt reply, we suggest you limit your request to a shorter time-frame and/or a more limited scope.

Thank you for keeping up with what appears to be mostly compliant Sunshine responses at this time.
Can you confirm that all redactions in the 36 records so far provided that are not specifically keyed to a justification are Constitutional privacy?
Can you also provide an estimate of how long it would take for DPW to produce say one month of Prop G calendars so I can extrapolate and prioritize?

What I care most about is that records don't vanish intentionally or through some auto-delete process. If everything is on litigation hold I guess it wouldn't matter anyway.

Regarding the formatting, I specifically was asking about how much of the information you were requesting and the view.

For example, the 2015 calendar that we released to you showed a PDF version of each single day with summary information, but it did not contain a full list of attendees, affiliations and contact information that is required of some calendar entries under Prop. G. 

As you can imagine, it would be much faster for us to produce the records in this daily format. In contrast, in response to your previous requests, we have created a PDF of each individual calendar item (or two if the list of attendees is required), then review for redactions, etc. Because of how information is kept on the director's calendar (such as vacations or sick days of key employees, recurring meetings that are informational only and not attended), there may be a dozen or even dozens of individual entries each day that need to be formatted.

Also, I just found out that Myisha is not in today, so I will get back to you next week with an estimate of how long it should take to produce records in response to this request.

This is an immediate disclosure request for the single earliest-in-the-day calendar entry in your current department head's business Outlook calendar for December 15 in the electronic form of an iCalendar or ICS file with minimal redactions and keys for the redactions.

Please Note:
1) Metadata has been ruled by the SOTF to be public and disclosable, and it must be redacted with footnote or other clear reference. (See SOTF 19044, 19047, 19098, 19105).
2) DPW has already accepted the public/disclosable nature of metadata by providing some, but not all, of the partially redacted email header metadata in SOTF 19097.
3) The iCalendar (ICS) format is "available" or "easily generated" (note, nothing is said about the ease of redaction, merely the ease of generation). In fact, in SOTF 19047, an SOTF member demonstrated to the Mayor's Office, live during the hearing, in a few seconds how to generate .ICS files from their own Outlook calendar.
4) The Dept of Technology has provided partially redacted ICS files of the Chief Information Security Officer's calendar, demonstrating that this is possible and does not pose a security risk: https://sanfrancisco.nextrequest.com/documents/5706615

Again, you appear to be making an incorrect assumption. To my knowledge, we have never used PDFMaker. NextRequest converts Outlook files into individual components and redacted documents are converted to PDFs. Before we migrated to NextRequest, we often used Adobe Acrobat Pro, not PDFMaker.

Regarding Item 2, pursuant to Mayor London Breed's Proclamation dated March 13, 2020, Sections 67.25(a) and 67.25(b) of the Administrative Code are suspended for the duration of the local emergency.

City employees' attacks on the First Amendment to protect their actions from scrutiny will itself be scrutinized. There's no difference when SF agencies attacks transparency versus when the former President did. At least one City employee, Ms. Boomer, seemed to understand.

For emails in others' accounts, I have to go through IT to get .pst files that either have to be converted or uploaded into NextRequest. Using NextRequest to extract the emails greatly increases our ability to provide the documents in a timely manner and does provide you with all of the records you have requested.

This is a 67.21(d) petition against DPW to determine in writing public and order disclosed the records withheld in request 21-951 under the citation "per the San Francisco Campaign and Governmental Conduct Code Article IV. ". First that is not a specific section of law, it is an entire article. Second, local law cannot exempt information that is disclosable under state law; local law can only increase transparency not decrease it. A state PRA exemption must be cited, and it is possible that none exists.

BALA is now pressing for another meeting to discuss their proposed changes to the bag and tag policy
(and other issues unrelated to DPW, see below). Per our discussion several months ago, I went through
their suggested edits and made revisions. I did not modify the edits that I had suggested and sent to BALA
months ago after DPW approved such changes. I understand that Public Work raised questions with
regard to some of those previous edits in our call, but we would need a compelling reason to renege on
agreements already made and communicated to BALA. Please take a look at the attached and let me
know if you would like to discuss further or have edits or concerns.

A couple of things to note:

1. The lawsuit against Los Angeles in which the court found the bulky item exception to be unlawful
has been appealed. We have not agreed to changes to the bulky item exception in the policy, and we
told them we are monitoring the appeal of the Los Angeles case. But you should prepare for the
possibility that the Court of Appeal will uphold the district court??s decision and we will need [sic]
make a change. It??s also possible that BALA could bring a legal challenge to our policy before
the appeal is resolved.
2. My understanding is that Public Works does not want the policy to require notice before bagging
and tagging in response to 311 complaints. This is legally risky as we have previously advised and
could form the basis for a successful challenge to the policy
3. They have continually asked about a reasonable accommodation policy and training. Has your ADA
coordinator been consulted and is there any update?

I would prefer to reach agreement internally on the proposed changes and send to BALA but not agree to
any further meetings on this subject. Jeremy, feel free to chime in if you have other thoughts on how to
proceed or if I??ve missed anything.
