Pursuant to the Vermont Public Records Act, I hereby request the following records:

The roster of all current BPD officers. For each officer, please be sure to include at least the following fields:

- Name
- Rank
- Badge number
- Date of hire
- Race
- Gender
- Date or year of birth
- Primary unit assignment or job title (such as "patrol," "motorcycle," "street crimes," etc.)

If applicable, please also include a history of badge numbers (for example if badge numbers change upon promotion).

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Brian,

In response to your request, attached is a roster of all of our sworn staff (police officers) that includes their name, rank, badge number and date of hire. We do not have any rosters that contain the roster information and the other information your requested as that type of document does not exist.

§ 317. Definitions; public agency; public records and documents
(b) As used in this subchapter, "public record" or "public document" means any written or recorded information, regardless of physical form or characteristics, which is produced or acquired in the course of public agency business.

You have the right to appeal a determination that a record or a portion thereof is exempt to Burlington Police Chief Brandon del Pozo (802) 540-2107, pursuant to 1 V.S.A. § 318. Such an appeal will be decided upon in 5 business days of the receipt of your appeal. If you are aggrieved by a denial by the department head, you may then appeal to the superior court pursuant to 1 V.S.A. § 319.

Hello Chief Wright,

Thank you for the fastest public records response I have ever experienced! I'm writing to clarify the omission of demographic information in the data. Given that the Chief has made diversity hiring a priority for the department, it seems like records regarding race, age, gender, etc. of officers would be kept. Can you clarify why it's not included in the roster or whether it can be found elsewhere?

The rosters of names are actually our “seniority” lists and are separated into our Burlington Police Officers Association (BPOA)(bargaining unit) list, AFSCME list and Non Union list of employees. All employees are on one of those lists. These are the only “rosters” we have.

Since Human Resources actually keeps the information regarding race, you might want to see if they have that type of roster.
