From: Nick Ingalls

To Whom It May Concern:

Pursuant to Michigan's Freedom of Information Act ("FOIA"), I hereby request the following records:

A Shapefile or CSV containing at minimum the Address Points (house # and street name) and their corresponding Latitude/Longitude. If additional data such as the Unit Number, City, Zipcode, Parcel Id exists they should be included as well.

If this cannot be accessed, the parcel file including situs address would suffice.

Other names for this include: E911 Address Database, Civic Address File, Parcel Dataset, Land Ownership Dataset, Tax Parcels, Address Points.

I also intent to publish the data via the OpenAddresses Publication platform and would request a waiver of fees for the request.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Sincerely,

Nick Ingalls

Good morning,

This written communication is in response to your Freedom of Information Request; see below.

Pursuant to MCL 15.236, Section 5(2), "a public body shall respond to the request for a public record within five business days after the public body receives the request by doing one of the following:"....(d) issuing a notice extending for not more than ten business days, the period which the public body shall respond to the request."

Please be advised, the County is extending for ten (10) business days the period for responding to your request. As a result of this extension the County will do one of the following by January 3, 2018;

* Grant the request.
* Issue a written notice denying the request.
* Grant the request in part and issue a written notice denying the request in part.
* Issue a notice indicating that due to the nature of the request the County needs an additional 10 business days to respond for a total of no more than 15 business days. Only one such extension is permitted.
* Issue a written notice indicating that the public record requested is available at no charge on the County's website.

The reason for extension is the County needs the additional time to search for, collect, and/or appropriately examine or review the public records that you have requested.

Sincerely,

Becky Blaine

Good afternoon,

I have received your request (below) and processed it under the provisions of the Michigan Freedom of Information Act (FOIA), P.A.442, of 1976, as amended.

Your request is denied on the grounds that it does not sufficiently describe specific existing public records under Section 3(1) of the FOIA to constitute a valid FOIA request. The FOIA does not require a public body to make a compilation, summary or report of information.

The GIS data and related services may be accessed under the County's Enhanced Access Policy for purchase through the associated GIS Fee Schedule form Land Information Services. Feel free to contact GIS directly:

Geographic Information Services
3283 122nd Ave.
Allegan, MI 49010
Phone: (269) 673-0518

In addition, the County has made the County's GIS Parcel data available for free download from the County's GIS data library: http://cms.allegancounty.org/services/GIS/SitePages/Home.aspx.

Notice of Requestor's Right to Appeal or Seek Judicial Review
You are entitled under Section 10 of the Michigan Freedom of Information Act, MCL 15.240, to appeal this denial to the County Board or to commence an action in the circuit court to compel disclosure of the requested records if you believe they were wrongfully withheld from disclosure. If, after judicial review, the court determines that the County has not complied with the FOIA in making this denial and orders disclosure of all or a portion of a public record, you have the right to receive attorney fees and damages as provided in MCL 15.240.

If you have any questions, please feel free to contact me at my direct number 269-673-0239 or email bblaine@allegancounty.org<mailto:bblaine@allegancounty.org>.
